Land situate in Springhill Township. --------------------------------------------------------------------- Jackson Harden, pn shff. To Thomas W. Lyons To all People to whom these Presents shall come. I Calvin Springer, High Sheriff of the County of Fayette in the Commonwealth of Pennsylvania, send Greeting. Whereas, D.R. Gans (lately) in the Court of Common Pleas holden at Uniontown, for the County of Fayette, before the Judges of the same Court, to writ, on the day of Dec. in the year of our Lord one thousand Eight hundred and seventy five by the judgment of the same Court, did recover against Jackson Harden of said County the sum of Two hundred and thirteen dollars and forty-five Cents, as, also Twenty dollars Costs, which to the said were adjudged in the said Court for his costs and charges by him about his suit in that behalf expended. And whereas, Afterward, by a writ of the Commonwealth aforesaid Fieri Facias, issued out of said Court, and numbered sixty-six of March Penn in the year of our Lord one thousand eight hundred and seventy six and to me directed, I was commanded, that of the goods and chattels lands and tenements of the said Jackson Harden in Bailiwick. I should cause to be made and levied the Debt and Costs aforesaid, which the said D.R. Gans had recovered against the said Jackson Harden as aforesaid, and that I should have that Money before the Judges of the said Court the first Monday of March (then) next to render the said D.R. Gans for his said debt and costs and the said writs. By virtue of which said writ of Feiri Facias, of the land and tenements of the said Jackson Harden (he having no goods or chattels in my bailiwick wherewith to satisfy the said execution) seized and took in execution all that certain tract or parcel of land situate in Springhill Township Fayette County Penna Containing one hundred and sixty one acres of land more or less. Adjoining the lands of Libbins Gans & others on which erected a stone dwelling house Barn and out buildings and large apple orchard, &c &c., and Whereas by Inquisition intended and and to the said writ annexed it appeared by the oaths and affirmations of twelve good and lawful men of my bailiwick that the rents issues and proffits of the aforesaid were not sufficient beyond all reprises to satisfy the said debt and damages within the the term of sum Years and that the said premises remained in My hands unsold for want of buyers. And Whereas, afterward, by a writof Venditioni Exponas of the said Commonwealth, issued out of the said Court, listed the day of Dec. in the Year of our Lord one thousand eight hundred and seventy four and to Me directed, I was Commanded That the alnds and Tenaments aforesaid, so taken in Execution as aforesaid, I should expose to sale, and that I should have the money thereof before the Judges aforesaid at the said Court, the first Monday in March then next; to render to the said D.R. Gans in said writ mentioned, and the said writ. And Whereas I, the said Sheriff having given due and public Notice of the time of sale, did, on the seventh day of March in the year of our Lord one thousand eight hundred and seventy six Expose the lands, tenements and premises to sale by public vendue or outcry, and sold the same to Thomas W. Lyons for the sum of Fifteen thousand and seventy five dollars lawful money of the United States, In being the highest and best bidder and that In highest and best price bidden for the same. How know Ye, That I, the said Calvin Springer, Sheriff of County aforesaid, for and in the consideration of the aforesaid sum of Fifteen thousand and seventy five dollars, lawful money of the Unites States, to me in hand paid by the said Thomas W. Lyons at or before the ensealing and delivery hereof, the receipt whereof is hereby acknowledged, Have granted, bargained, and sold and by these presents according to the directions, and by virtue and force of the said recited writs and of the laws of Pennsylvania, in such cases made and provided, Do grant, bargain and sell unto the said Thomas W. Lyons heirs and assigns, all that the said lot or parcel of land aforesaid situate in Springhill Township Fayette County Pennsylvania Containing one hundred and sixty one acres more or less adjoining the lands of Libbins Gans and others. Together with all and singular the buildings, barns, stables orchards, improvements, rights, priviledges, hereditadments and appurtanences whatsoever there unto belonging or in anywise appertaining, and the reversions and remainers and the rents issues and profits therof. To Have and to Hold the said described lot or parcel of land hereby granted or mentioned, or intended so to be, with the appurtenances, to the said Thomas W. Lyons heirs and assigns, to the only proper use and benefit and behoof of him the said Thomas W. Lyons heirs and assigns forever, as fully and for such estate, and under such conditions as the said Jackson Harden had and held the same at the terms of the judgment aforesaid, according to the firm and effect of the said recited writs, and the Acts of Assembly of Pennsylvania, in such cases made and provided. In Witness Whereof, I, the said Calvin Springer, Sherriff of the said County of Fayette, have hereunto set my hand and seal this day of in the year of our Lord one thousand eight hundred and seventy Sealed and delivered in the presence of Calvin Springer C.S. Wm Lewis John M. Richards Received on this day last mentioned of the before mentioned Thomas W. Lyons the sum of Fifteen Thousand and Seventy five dollars lawful money of the United States, the full consideration before mentioned Test Wm Lewis Calvin Springer Fayette County, Ss: Acknowledged after the proclamation at a Court of Common Pleas held at Uniontown, Pa, for the County of Fayette before the Judges of the said Court, by the said Calvin Springer, Esquire, Sheriff of the said County the Sixteenth day of June in the year of our Lord one thousand eight hundred and seventy six.
