THIS INDENTURE, Made the Sixteenth day of November in the year of our Lord one thousand nine hundred and eight BETWEEN Howard W. Beighley of Smithfield, Fayette County, Pennsylvania, party of the first part ( and a single man) and Charles Mossburgh of Nicholson Township, County and State aforesaid, party of the second part, WITNESSETH, That the said party of the first part, for and in consideration of the sum of two thousand and two hundred dollars lawful money of the United States of America unto him well and truly paid by the said party of the second part, at and before the sealing and delivery of these presents, the receipt whereof is hereby acknowledged, has granted, bargained, sold, aliened, enfeoffed, released, conveyed and confirmed, and by these presents does grant, bargain, sell, alien, enfeoff, release, convey and confirm, unto the said party of the second part, his heirs and assigns, All those two certain lots of ground in the Howard W. Beighley addition to Smithfield Borough in FayetteCounty, Pennsylvania and known as lots number 11 and 12 in said Addition. Said lots taken together have a total frontage of eighty feet on the Baltimore and Ohio Railroad right of way and extend back at right angles to said right of way and of even width one hundred and forty three and 55/100 ( 143.55) feet to a ten foot alley. Said lots are a portion of that piece or parcel of land conveyed to Howard W. Beighley by Joseph G. Burchinal, assignee of Luther W. Burchinal, by his deed dated the tenth day of September A.D. 1888 and recorded in the Record Office of Fayette County in the Deed Book Vol. 81, page 240. TOGETHER with all and singular the said property improvements, ways, waters, water courses, rights, liberties, privileges, hereditaments and appurtenances whatsoever thereunto belonging, or in anywise appertaining, and the remainders, rents, issues and profits thereof, and all the estate, right, title, interest, property, claim and demand whatsoever of the said party of the first part, in law, equity or otherwise howsoever of, in and to the same and every part thereof, TO HAVE AND TO HOLD, the said described lots numbers 11 and 12, hereditaments and premises hereby granted or mentioned, and intended so to be, with the appurtenances, unto the said party of the second part, his heirs and assigns, to and for the only proper use and behoof of the said party of the second part, his heirs and assigns FOREVER. AND Howard W. Beighley, the said party of the first part, for himself, his heirs, executors and administrators, does by these presents covenant, grant and agree to and with the said party of the second part and his heirs and assigns, all and singular, the hereditaments and premises herein above described and granted or mentioned and intended so to be, with the appurtenances, unto the said party of the second part, his heirs and assigns, against him, the said party of the first part, and his heirs and against all and every other person or persons whomsoever, lawfully claiming or to claim some or any part, and his heirs shall and will warrant and forever defend.
