Mossburgh THIS INDENTURE, Made the third day of February in the year of our Lord one thousand eight hundred and ninety BETWEEN Ira E. Partridge and Harold L. Robinson & Laverne his wife all of Uniontown Fayette Co Pa parties of the first part and John W. Mossburgh of North Union Township County and State aforesaid party of the second part, WITNESSETH, that the said parties of the first part, for and in consideration of the sum of Two hundred Dollars lawful money of the United States of America, unto them well and truly paid by the said party of the second part, at or before the sealing and delivery of these presents, the receipt whereof is hereby acknowledged, have granted, bargained, sold, aliened, enfeoffed, released, conveyed and confirmed, and by these presents do grant, bargain, sell, alien, enfeoff, release, convey and confirm unto the said party of the second part, his heirs and assigns, All that certain lot of ground situate in the fourth ward Borough of Uniontown & described as follows Beginning at the point of intersection of the Downer lot with the western side of Main Street running thence south sixty five feet & three eighths degrees along lot aforesaid. West seventy seven & Eight tenth feet to a ten foot alley thence along said alley south sixty six & three fourths degrees- East forty six and five tenths feet to rear point of lot No 7 thence along said lot North sixty five & three eighths degrees East forty six and three fourths feet to Main street thence along line of said street North twenty four & five eighths degrees West thirty five feet to place of beginning, being the lot designated as No 8 on the plan of lots laid out by aforesaid Partridge & Robinson in December 1889 recorded in the proper Office for this County in Plan Book no__ page__ and being Granted by Josiah J. Allebaugh & wife by deed dated Dec 9, 1889 Excepting from said grant all the coal & minerals underlying the said lot with the rights to mine & extract the same without prejudice to the enjoyment & use of the surface by owner thereof. TOGETHER with all and singular the said property improvements, ways, watercourses, rights, liberties, privileges, hereditaments and appurtenances whatsoever therunto belonging, or in anywise appertaining, and the reversions and remainders, rents, issues and profits thereof; and all the estate, right, title, interest, property, claim and demand whatsoever of the said parties of the first part, in law equity or otherwise howsoever of, in and to the same and every part, thereof, TO HAVE AND TO HOLD the said lot of ground ( with the exception herein before set forth) the hereditaments and premises hereby granted or mentioned and intended so to be with the appurtenances, unto said party of the second part, his heirs and assigns, FOREVER. AND Ira E. Partridge & Harold L. Robinson and Lavenia Robinson the said parties of the first part for themselves their heirs, executors and administrators, do by these presents covenant, grant and agree, to and with the said party of the second part, his heirs and assigns, that they the said parties of the first part and their heirs, all and singular the hereditaments, and premises herein above described and granted, or mentioned and intended so to be, with the appurtenances, unto the said party of the second part, his heirs and assigns, against them the said parties of the first part, and their heirs, and against all and every other person or persons, whomsoever, lawfully claiming or to claim the same or any part thereof: Shall and will Warrant and Forever Defend. Partridge Harold L. Robinson and Lavenia R. Robinson who in due form of law acknowledged the foregoing Indenture to tbe their act and deed and desired that the same might be recorded as such. The said Leverna R. Robinson being of full age and by me examined Seperate and apart from her said husband and the contents of the said Indenture being first made fully known to her declared that she did of her own free will and accord sign and seal and as her act and deed deliver the same without any coercion or compulsion of her said husband.
