PA This endenture made the seventeenth day of September in the year of our Lord one thousand eighteen hundred between John Myers late of German Township, Fayette County and Commonwealth of Pennsylvania, the son of Ulrich Myers late of the same place deceased and Hannah his wife, William Myers and Flora his wife, Henry Myers and Hannah his wife, Jacob Weigle who entermarried with Mary the daughter of said Ulrich Myers and the said Hannah his wife formerly all of the same but lately removed to Montgomery county in the Kentucky country and George Colvin who intermarried with Hannah the daughter of the said Ulrich Myers and the said Hannah his wife of the one part and Jacob Ousler of German Township and the county of Fayette aforesaid yeoman of the other part witnesseth that whereas the said Ulrich died possessed or seized of an equitable claim to a certain tract of land situate in German Township aforesaid on the waters of Dunlap creek in the county and commonwealth aforesaid who in and by his last will and testament duly approved in Monongalia county and Commonwealth of Virginia “whose jurisdiction they were then under” bearing date the twenty-fifth day of January Anno Domini Seventeen Hundred and Seventy-seven, did give unto his wife Hannah the third part of his plantation during her life, together with all of his household goods and debts subject to the payment of certain legacies after her decease and whereas the said land so as aforesaid willed to the aforesaid Hannah was also liable or subject to the payment of the purchase money to the Commonwealth of Pennsylvania and the said Hannah having discharged the same perfected a title as by her warrant issued by the Secetary of the Land Office of the State of Pennsylvania bearing date the twenty-ninth of October in the year of our Lord One Thousand Seven Hundred and Eighty -four. The said Hannah remained the widow of the said Ulrich and died intestate without other issue from her body than those of the said Ulrich and the heirs or legatees aforesaid so agreeing have thought it most fitting to sell and dispose of the land and premises at private sale without division or partition of the same, being fully satisfied and having made up their accounts with each other and for and in consideration of the sum of one hundred and twenty pounds lawful money of Pennsylvania to them the said John Myers and Elizabeth his wife, William Myers and Flora his wife, Henry Myers and Hannah his wife, Jacob Weigle and Mary his wife, George Colvin and Hannah his wife or some of them in behalf of the whole by the said Jacob Easter paid the receipt whereof or some of them on behalf of the whole doth hereby acknowledge and do hereby acquit, discharge and exonerate the said Jacob Easter his heirs, executors and administrators from the same have granted, bargained, sold, released _________ assigned and confirmed and by these present that the said John Myers and Elizabeth his wife, William Myers and Flora his wife, Henry Myers and Hannah his wife, Jacob Weigle and Mary his wife, George Colvin and Hannah his wife do grant, bargain, sell, release “enfee” assign and confirm unto the aforesaid Jacob Easter and to his heirs and assigns all of the estate right title interest property claim and demmand whatsoever of the aforesaid John Myers and Elizabeth his wife, William Myers and Flora his wife, Henry Myers and Hannah his wife, Jacob Weigle and Mary his wife and George Colvin and Hannah his wife their heirs, executors, administrators and every one of them of in and unto the said above recited warrant and patent and tract of land and premises thereby granted mentioned and intended with the _________ and the appurtances thereonto belonging or in any wise of right appertaining and the reversions reminders rents issues and profits thereof to have and to hold the same as it is hereafter described and bounded unto the said Jacob Easter his heirs and assigns, to the only proper use benefit behoof of him the said Jacob Easter his heirs executors administrators and assign forever: Beginning at a post in the line of John Works land hence by the lands formerly of William Myers now the said John Works south twenty_two degrees and a half west one hundred and ten perches ________ service south Twenty-three degrees East three perches to a post and south thirty degrees and one half west one hundred and eight perches to a post in the line of Jacob Easter and hence by the same north thirty eight degrees and a half west 130.6 perches to a post at corner of Henry Myers land formerly now Mark Easter hence by the same north fifty-nine degrees east one hundred ninety-three pershes to a post in the aforesaid line of John Works and hence by the same south sixty-six degrees and three-guarters east twelve perches to the place of beginning containing eighty- seven acres and three-quarters and the usual allowances for roads and the said John Myers and Elizabeth his wife, William Myers and Flora his wife, Henry Myers and Hannah his wife, Jacob Weigle and Mary his wife, George Colvin and Hannah his wife against them and their heirs as well as against any other person whomsoever the said bargained promises and every part and appurtance unto the said Jacob Easter his heirs executors administers and assigns shall and will warrant and forever defend by these present, the reservation of one-fifth part of all gold or silver ore to be delivered to the pit mouth, clear of all charges reserved for the use of the Commonwealth of Pennsylvania and all taxes and assignments thereafter growing due on the same only excepted and the ssaid John Myers and Elizabeth his wife, William Myers and Flora his wife, Henry Myers and Hannah his wife, Jacob Weigle and Mary his wife and George Colvin and Hannah his wife for themselves and their heirs executors and administrators doth covenant and agree to and with the said Jacob Easter his heirs executors administrators and assigns as followeth Viz That the said John Myers and Elizabeth his wife, William Myers and Flora his wife, Henry Myers and Hannah his wife and George Colvin and Hannah his wife their heirs executors administrators or any of them shall at any time hereafter at the reasonable request and at the proper _________ and charges in the _________ of him the said Jacob Easter his certain attorney heirs executors administrators or assigns make and execute such further or other deed or deeds as may be required for the more perfect conveying and assuring the above bargained premises unto the said Jacob Easter his heirs executors administrators or assigns as by him or them shall be reasonably required in witness thereof and the parties to these present have set their hands interchangeably affixed their seals the day and year above written. Sealed and delivered in the Jacob Weigle William Myers presence of us the sud- Mary Weigle Flora Myers scribing witnesses by George Henry Myers George (X) Colvin Colvin and Hannah his wife Hannah Myers Hannah (X) Colvin the eleventh day of October 1801. The word “Elizabeth” was written in over an erasure and the words “of the first part” and “containing 130.6 perches”. Also the word “eight” in the first line.(This wording is a part of the deed and not a note made by the intrepeter) This day personally appeared before us, two of the Justices of the Peace of and for Montgomery County, Jacob Weigle and Mary his wife, Wm. Myers and Flora his wife and Henry Myers and Hannah his wife and each of them acknowledge the written obligation and ordered the same to be recorded given under our hands and seals a subscribing Justice of the aforesaid county this 17th day of September 1800.
