JOSEPH AND ISOLINE SHAFFER OF WHITE, SALTLICK TOWNSHIP PARTLY RESPONSIBLE FOR SON’S DEATH That equal responsibility for the death of their son through the accidental discharge of a shotgun rested on the parents, was the decision of the court in Uniontown yesterday in the case of Joseph and Isoline Shaffer of White, Saltlick township, against Charles M. Mowery, a merchant of that place, to recover damages for the death of their son, Henry, seven years old, who was shot and killed by his brother, Samuel, 14 years old. The merchant sold to Samuel the shell which caused the boy’s death. The gun from which the load was discharged had been borrowed from a neighbor and was being returned at the time of the mishap. The court held that while the merchant was negligent in selling the shell to the boy, the parents also were negligent in permitting the children to have the gun. Therefore, the court overruled the plaintiff’s petition to have the non-suit stricken off.
