I Thomas Batton of Springhill Township Fayette County and Commonwealth of Pennsylvania, considering the uncertainty of this mortal life and being of sound and perfect mind and memory blessed be Almighty God for the Same do make and publish this my Last Will and Testament in manner and form following (that is to say) First my house and that part of my plantation on which I now live and described by the following bounds; beginning at a pile of stones, a corner on the line between the lands of William Lyons and my Self the nearest corner to the house formerly occupied by Lewis Duvall to run thence by the fence between my meadow and field with it comes to the corner at the upper side of the meadow thence nearly North by the fence between two fields until it strikes the corner, thence nearly northwest by the fence until it strikes the northeast corner of the orchard thence nearly northwest, a straight line through the woods to the nearest corner of my land on the line of the land of the heirs of Joshua Brown thence by the lands of said Lyons and those of Lewis Getzandaner, John Stumm and William Lyons to the place of beginning, this described part of my plantation is to come into the possession of my son, John H. Batton from the day of my decease until his Eldest Son yet unborn shall arrive to the age of twenty one years. In consideration of which he the said John H. Batton is to pay my Executors yearly what they may consider a reasonable rent It is to be observed that the part of the above described piece of Land now occupied by Huel Downs shall be rented to him or some other person during the above mentioned term of time if my son John H. Batton shall not have a son born the term of time he shall hold this land on Rent shall be until his two oldest daughters shall arrive to the age of eighteen years. If he has a son born I give and Bequeath all that part of my plantation above described to him as soon as he arrives to the age of twenty one years If he has not a son, I give and bequeath to his two eldest daughters each equal as soon as they arrive to the age of eighteen years To my son John’s heirs alike who shall not become possessed of the above land or any part thereof I give and bequeath all the rent arising from the above mentioned part of my plantation to be paid them each equal by my executors, as soon as they are at a proper age to receive it. To my son John H. Batton I give all my farming utensils including wagons and gears all the remaining part of my plantation not included in the above bounds, it is my will shall be rented out until my debts are paid out of the rents arising there from at which time if a sale can be effected for the value of the land it is to be sold to the highest bidder giving a reasonable time to make yearly payments the money there arising to be divided into five equal shares which I dispose of as follows to daughter Rachel John I give and bequeath one fifth part of the money arising from the sale. To my daughter Anna Crawford I give and bequeath ten pounds and the remainder of her one fifth part to be equally divided among her children. To my daughter Polly Fickey I give and bequeath ten pounds and the remainder of her one fifth part to be divided among her children. To my two daughters, Hannah and Betsy Batton, I give and bequeath each one fifth part of the money arising from the sale of land. To my two younger daughters Hannah and Betsy Batton I give and bequeath all my household furniture if it is ascertained as soon as my debts are all paid that a sale cannot be affected for the value of the land. It is to be continued on rents until it can be disposed of for its value all the rents to be divided among respective legatees in the same manner and proportion as the money arising from the sale. In either case of sale or rent the money arising to be paid to the respective legatees as soon as it is due and collected except as much as is due to my non legatees which money is to be put on Interest from the time it is due until they arrive at a proper age to receive it. I hereby appoint Peter & Daniel Stentz sole executors of this my last will and testament hereby revoking all former wills by me made in witness thereof I have hereunto set my hand and seal the third day of September in the year of our Lord one thousand eight hundred & Twenty.
