All rights reserved. http://www.usgwarchives.net/copyright.htm http://www.usgwarchives.net/pa/pafiles.htm ************************************************ File contributed for use in USGenWeb Archives by: Deanna Sharkey DSharkey@optonline.net January 25, 2006, 12:37 pm Source: Register Of Wills Office, Fayette County Written: October 9, 1837 Recorded: March 30, 1838 Will of Peter Colley In the name of God amen, I Peter Colley of Redstone Township, Fayette County state of Pennsylvania, being in reasonable health of body and of sound and disposing mind and memory, duly considering that it is appointed for all men once to die, and being mindful of the uncertainty of that great change, when it shall please Almighty God to call me hence, and feeling very desirious to settle all my worldly affairs whilst I have strength and capacity so to do, Do make and publish this my last will and testament, hereby revoking and making void all former wills by me at any time heretofore made. First and principally I commit my soul into the hands of Almighty God who gave it, and my body to the earth to be interred in the burying ground at Fairview, meeting house, where my dear wife is interred. And as to such cordly Estate wherewith it hath pleased God to entrust me I dispose of the same in the following manner "to wit," First, I will and bequeth to my son John Colley one dollar which together with the issues and profits of one of my farms for a series of years I consider his full portion and share of my Estate, which sum of one dollar is to be paid by my son George Colley out of what is herein after divised to him, Second, I will and bequeth to my son George Colley my home plantation including the house and lot of ground occupied by Andrew Cox and also that piece or parcel of land which I purchased from the administration of John Fulton jr. deceased, containing in all about three hundred and twenty acres more or less and bounded by lands of Hasting heirs Joseph Gadd hiers of John Fulton jr. Richard Mills and others, he my said son George paying the legacies herein after mentioned to be paid by him "to wit." I will and bequeth to my daughter Catherine Dillon two hundred dollars to be paid by my son George within one year after my decease, I will and bequeth to my daughter Sarah Denman two hundred dollars, to be also paid by my son George within two years after my decease, I will and bequeth to my daughter Hannah Woodmancy two hundred dollars to be paid also by my son George within three years of my decease, all of which payments are to be made without interest for the time specified. Third, I will and bequeth to my son Solomon Colley my plantation known by the name of the "Adam's Place" containing about one hundred and twenty five acres more or less, bounded by lands of William Hatfield Phillips heirs Davis Jackson and others, he my son Solomon paying Elizabeth Lynch one hundred dollars out of what is above divised to him within one year after my decease, I will and bequeth to my daughter Elizabeth Lynch a certain house and lot of ground, where she now resides, containing nine acres more or less adjoining lands Wm. Hatfield, Danl. Phillips and others also the sum of one hundred dollars to be paid by my son Solomon out of what is herein divised to him, within one year after my decease. Fourth, I will and bequeth to my son Abel Colley the following described tracts of land "to wit" the Saml. Adams tract with the exception of ten acres of of said tract adjoining to and including the buildings at the Old Tavern Stand at the Plumpsock Road, which tract after the said deduction of ten acres to include the said buildings will contain about one hundred and ten acres occupied at present by the heirs of David Colley deceased also the tract called the "Frost Place" containing about thirty acres more or less, also the Tavern Tract containing about fifty five acres, making in all about two hundred acres more or less, adjoining lands of Joseph Beall Phillips heirs Wm. Searight and others, he my son Abel Colley is to pay out of what is hereby devised to him the following named legacies "to wit." I will and bequeth to my daughter Nancy Hutton three hundred dollars, to be paid by my son Abel Colley, within two years after my decease. I will and bequeth to my grand daughter Nancy Frost three hundred dollars to be paid by my son Abel Colley within one year after my decease, this last mentioned legacy is the full portion which would be going to my daughter Mary Frost were she living, but as she is deceased, it is therefore devised to her daughter the said Nancy Frost. Fifth, I will and bequeth to my grandson Peter Colley, son of my son David Colley deceased, that tract of land known by the name of the "Mauler Tract" containing about ninety four acres more or less, also ten acres adjoining to and including the buildings at the "Old Tavern Stand", at the Plumpsock Road, the said ten acres to be laid off along said Plumpsock Road, so as to be most convenient to said buildings,(the residue of said tract called the Adams Tract is above devised to my son Abel Colley) making in all hereby bequeth to my grandson Peter Colley, son of David Colley, about one hundred amd four acres more or less, the said Peter is to pay out of what is hereby devised to him the sum of one hundred dollars, to my daughter-in-law Mary Colley,widow of David Colley and mother to said Peter Colley, which sum must be paid within one year after my desease, which sum of one hundred dollars is hereby bequethed to the said Mary Colley these two last mentioned legacies is the portion and share of my Estate which would be going to my son David Colley were he still living; with respect to my personal Estate, I will and bequeth the same as follows, to my grand daughter Nancy Frost I will and bequeth one featherbed, bedding and bed sted which is now in use by her also a case of walnut drawers containing some bedclothing, also, one side saddle and one cow called "Spot". All the residue of my personal estate consisting of goods chattels and stock, I will and bequeth to my son George Colley in consideration of which he is to pay all expences, which may occur previous to and at my last illness, my funeral expences and all expences attending the proving this my last will. It is further my will, that if I shall have any sum or sums of money on hand at the time of my death, the same is to be equally divided between my two sons Solomon and George. I hereby constitute, and appoint my sons Solomon Colley and George Colley my executors, hoping that they will fully execute all things mentioned in this my last will and testament. In testimony of this being my last will and testament, revoking and making void all others heretofore made by me. I have hereunto set my hand and affixed my seal this ninth day of October, in the year of our Lord one thousand eight hundred and thirty seven. Signed and Sealed in presence of: Peter Colley(seal) Phillip Fought ** Fayette County George Craft ** (reg.seal) ** Be it remembered that on the 30th day of March A.D. 1838, personally appeared before Roberts Barton, Register for the probate of wills and granting letters of administration in and for said county, Phillip Fought and George Craft subscribing witnesses to the foregoing testament and last will of Peter Colley late of Redstone Township, Fayette County deceased, and on their solemn affirmations did respectively declare that they saw the testator sign, seal and heard him acknowledge the same to be his last will and testament, when of sound mind, that they knew of no undue influence used or later will made by said deceased, to their knowledge or belief, and that they subscribed their names as witnesses thereto in his presence and in the presence of each other. In testimony where of I have hereunto set my hand and seal of the Registers Office,at Uniontown, the same day and year. Roberts Barton, Register.
