Moses Hopwood Sr. (1772 - 1857) Last Will & Testament Written: May 24, 1845 Probated: Oct 13, 1857 In the name of God, Amen. I, Moses Hopwood Senior of Union Township Fayette County Pennsylvania being sick and weak in body but of a sound and disposing mind, memory and understanding (Praised be God for it) and considering the certainty of death prepared to leave the world whenever it shall please God to call me hence, do therefor make, ordain and declare this to be my last will and testament in manner following (that is to say). First and principally, I commend my soul into the hands of Almighty God my Creator, hoping for a free and full pardon of all my sins, and to enjoy eternal life through Jesus Christ my savior. My body I commit to the dust at the will and discretion of my Executor, herein after manner, and until God shall reanimate and bid it rise. Secondly, I will and bequeath to my son Thomas Hopwood my mountain farm situated and lying in Union Township, Fayette County, Pennsylvania to be occupied and enjoyed by him for and during the term of his natural life. Said Hopwood to be restricted in the use of timber to the necessary improvements upon the farm and at his death I will and bequeath to his son Moses Hopwood (should he then be living) three acres of said farm including the Mill Seat and water privilege. Said three acres to be laid off in a square, the saw of the mill being the centre thereof. The balance of said farm after the death of said Thomas Hopwood (and in the event of his son Moses Hopwood being then also dead) the whole to go to my son Monroe Hopwood and his heirs forever. Thirdly, I will and bequeath all the rest and residue of my real and personal estate of whatsoever kind and wheresoever situated (after the payment of all my just debts and funeral expenses) to my said son Monroe Hopwood and his heirs forever. It is my will however in connection with this that my said son Monroe Hopwood shall pay or cause to be paid to daughter Hannah Hopwood so long as she shall live and remain a widow, the annuity or yearly sum of five dollars to be paid semiannually from the time of my decease. And lastly, I do hereby nominate and appoint my sons Moses Hopwood and Rice G. Hopwood to be the Executors of this my last will and testament. In witness whereof I the said Moses Hopwood Senior have to this my last will and testament on the last _____ thereof set my hand and affixed my Seal this 24th day of May Anno Domini one thousand eight hundred and forty five (May 24, 1845). Be it known that on this 13th day of October AD 1857 Personally appeared before me Jno Collins Register for the Probate of Wills and granting letters of Administration ___ in and for said County Henry W Beeson and Samuel Hatfield the above subscribing witnesses who being each duly affirmed, declares and says that they saw the Testator Sign & Seal, and heard him declare the above & forgiving as and for his last will and testament when of sound & disposing mind, memory & understanding that they know of no undue influence used or later will made by said dec'd. and that they signed the same at his request witness in his presence and in the presence of each other.
