I Jacob Moyer of Wharton Township, Fayette County Pennsylvania being far advanced in age but of sound mind and disposing memory do make this my last will and testament. First I commend my soul to God who gave it, and my body to the earth to be interred with decent Christian burial. Second I direct that all my just debts and funeral expenses including decent tomb stones be promptly paid out of the first monies that shall come to the hands of my executors. Third I order and direct that my personal estate be administered according to the laws of this commonwealth and that the net proceeds thereof be divided equally among all my children or their respective heirs as hereinafter directed in regard to the proceeds of sale of my lands. Fourth I order and empower my executors hereinafter named or the survivor of them, within one year after my decease to sell my land at public sale, upon such terms as to them shall seem most advisable and upon payment therefore or after bonds and mortgage or judgments given by the purchaser or purchasers to convey the same to such purchaser or purchasers in fee simply and upon receipt of the purchase money to divide and pay the same to my children or their respective heirs, so as to make each child's share equal, after adding to the whole of real and personal the following sums and deducting the same as advancements from each one's share with interest from my decease. The children of anyone dead or dying hereafter, to receive equally the share of his, her or other parent, viz: my son Philip seven hundred and seventy one dollars and 69 cents, my son Isaac four hundred fifty eight dollars and 85 cents, my son John two hundred forty four dollars and 47 cents, and my daughter Nancy (wife of Samuel Morton) Catherine (wife of Henry Yotter) Sarah (wife of Philip Workman) Barbara (wife of Samuel Moore) and Elizabeth (deceased wife of Evans Moore) each one hundred and fifty dollars. And should I hereafter advance to or pay for any of them any money or property to be evidenced by notes or otherwise, they are to account for the same in like manner, provided that is anyone's receipts amount to more that his or her share, then he or she is to pay the difference upon note or notes if being understood that the above sums are in part make up of notes and on some of said ch ildren, which I now hold. In making distribution I allow my executors to pay to the most needy first, and so on taking care to make them all equal in the end, according to the directions of this my last will. And should I at my death leave any unexecuted contracts for land, I empower my executors or the survivor of them upon receipt of security for the unpaid purchase money, if any, to make therefore such deed or deeds as I would be bound to make if living. I hereby revoke all former wills or writings testamentary by me made, and I name and appoint my son in law Evans Moore and my friend Amos Potter to be the executors of this my last will and testament. In testimony whereof I hereunto set my hand and seal this 20th day of July A.D. 1857. Everhart Bierer James Veich Fayette SS Be it known that on the 11th day of June A.D. 1875 before me Jos Beatty, Register of the Probate of Wills and Grating Letters of Administration in and for said County personally came Everhart Bierer one of the subscribing witnesses to the foregoing will of Jacob Moyer dec'd who being duly sworn did depose and say that he was present and saw the said Jacob Moyer sign and seal and heard him declare the same to be his last will and testament when of sound and disposing mind and memory to the best of his belief, that he signed his name as one of the subscribing witnesses thereto by request of the said testator I nhis presence and in the presence of the other subscribing witness James Veich who signed his name in his presence that he knew of no undue influence used or later will make. Same day personally came Alfred Howell and W.K. Gallaher who being each duly sworn did depose and say that they were well acquainted with the hand writing of said James Veich, having frequently seen him write his name that his signature to said will is genuine and his own proper hand writing to the best of their belief. That the said James Veich now resides in Allegheny County. In witness whereof I have hereunto set my hand and seal of the Registers Office at Uniontown the 11th day of June A.D. 1875 Jos Beatty, Reg.
