Book 1, p. 206 - 1820 Know all men by these presents that I, Jacob Newcomer of German Township, Fayette County, and Commonwealth of Pennsylvania, Being weak in body but perfect in mind and memory do hereby revoke all former wills by me made. And constitute , make ordain and declare this to be my lawful last will and testament, as follows, viz. Item 1 - It is my will and desire that my true and loving wife, Mary, may have the full enjoyment of all and singular my whole estate: real and personal to manage as she may think proper, while she lives and at her death the personal estate to be sold and the real estate to be appraised and sold also if my two oldest sons Jacob & John do not think proper to take it at the apraisement which right I reserve for them -only and the whole neat proceeds of my estate to be divided equally amongst my children that may then be living---- Item 2 - But in case my wife Mary do marry again then she is only to receive Fifty dollars, a bed and a cow and as she may think proper, to choose out of the Cattle and beds, then belonging to my Personal Estate and my Executors then to proceed as above - directed with both my real and personal estate dividing it as above directed, Equally amongst all my Children that may then be living.... Item 3 And Lastly I do Constitute and ordain(?) my wife Mary Newcomer and Jacob Beakseller of German Township my true and lawful Executors of this my last will and Testament. Given under my hand and seal this 4th day of January in the year of Our Lord one thousand Eight Hundred and Fifteen /s/ Jacob NueComent (Seal) Signed and acknowledged in presence of. The within will signed sealed and acknowledged in presents of; John Auld, James Auld, Samuel Allebaugh Fayette County S.S.(Seal) On the 3rd day of November Anno Domini 1820 personally appeared before Alexander McClean Register for the Probate of wills and granting Letters of Administration in and for said County, John Auld, esquire and Samuel Allebaugh the first and last signing witnesses to the foregoing last will and Testament and on their solemn attestation do severally declare that they saw the Testator and heard him acknowledge the same as and for his last will and Testament when of disposing mind and memory, that they know of no undue influence used to induce the Testator to make said will contrary to his own inclination or of any later will made by deceased.
