Will of SAMUEL NEWCOMER Book 9, p. 326 1894 I Samuel Newcomer, Senr. of German Township, Fayette County, PA being of sound mind memory and understanding and being conscious of the uncertainty of life and the certainty of death do make declare publish and establish this my last will and testament in manner and form as follows to wit re, First I give and bequeath to my son Allen Newcomer my home farm on which I now reside situate in German Township, Fayette County, PA containing ninety one acres more or less at the valuation of six thousand three hundred and seventy dollars { $6370.00) four thousand ($4000) to remain in said farm as an advancement of his portion of my estate, two thousand three hundred and seventy dollars ($2370.) to be paid by said Allen as follows one thousand dollars ($1000.) in one year after my decease and thirteen hundred and seventy dollars ($1370.) to be paid by said Allen as follows say two hundred dollars $200. per annum until all is paid. All payments to be without interest. the said sum of two thousand three hundred and seventy dollars $2370. to be paid into the hands of my Executors hereinafter named. Second, I give and bequeath to my said son Allen one two horse wagon two full set of harness (gearing?) one large plow and heavy harrow. Third I give and bequeath to my said son Allen and my daughter Eliza Ann in equal portions five head of live hogs and all the canned and dried fruits on hand at the time of my decease, that is to say the five hogs or the pork of five hogs. Fourth I give and bequeath to said son Allen all the grain in the ground at the time of my decease except thirty (30) bushels of wheat said wheat to be delivered into the hands of my said Executors for the benefit of all my heirjs. Fifth I give and bequeath to my daughter Eliza Ann my farm in Redstone township, Fayette County containing nintey five acres more or less and also all the grain on said farm at the time of my decease and also one horse and one cow and an out setting as as all the rest of my children have received. Sixth I give and bequeath to my son John M. Newcomer the sum of two thousand dollars ($2000.). Seventh, I give and bequeath to my son Samuel A. Newcomer the sum of one thousand dollars $1000. Eighth I give and bequeath to each of my two daughters namely Mary Rotharmel and Hannah Elizabeth Sapper the sum of one thousand dollars each ($1000.) making all my children equal so far. Ninth, I allow all my household goods to be equally divided among all my children. Tenth, I hereby appoint my son Samuel A. Newcomer and Samuel B. Rotharmel to be my executors with full power and authority to carry out and executer my said will in all its parts and provisions. Eleventh I allow the sum of fifty ($50.) to each of my executors as a full compensation for their service as Executors. Twelfth I order and direct that my said Executors shall as soon as the money shall have come into their hands pay over to those entitled as directed in my said will the remainder of my said estate to be equally divided among all my children being six in number. Thirteenth I order and direct that my said executors shall immediately after my decease to proceed to appraise and sell all my personal estate (except my household goods) and divide the proceeds arising from said sale among all my children. Fourteenth I direct that all my household furniture and goods shall be equally divided among all my children. Newcomer Fayette County (Seal) Be it remembered that on the 12th day of September A.D. 1894 before me William H. Binns, Register for the Probate of wills and granting letters of administration in and for said county came Martin Dickson and John W. Newcomer subscribing witnesses to the foregoing instrument of writing purporting to be the last will and testament of Samuel Newcomer deceased who being duly sworn according to law did each depose and say that they were personally present and saw the said Samuel Newcomer sign and seal the foregoing instrument of writing and heard him declare the same to be his last will and testament when of sound and disposing mind and memory to the best of their belief. That they signed their names as witnesses thereto by request of the said testator in his presence and in the presence of each other. That they know of no undue influence being used in making said will or any later will made. Sworn to and subscribed before me this 12th /s/ Martin Dickson day of Sept A.D. 1894, as witness my hand & official seal /s/ John W. Newcomer /s/ Wm. H. Binns, Register Now September 12th 1894 the testimony of the above witnesses being adjudged sufficient I do hereby admit the foregoing will to Probate and order the same to be recorded as such.
