I Richard Phillips of the Township of Franklin and County of Fayette and Commonwealth of Pennsylvania being weak in Body but of sound mind and and memory blessed be Almighty God for the same do make and ordain this to be my lst will and testament in the manner and form following, First my will is that my body be buried in a christian like and Decent manner with a Tom Stone at my head with my Sire and Christian name day of my decease. Secondly I will that all my debts and funeral charges be paid out of my personal Estate. Thirdly I give and bequeath unto my Stepson John Tumbleston five shillings to be levied and raised out of my personal Estate, Fourthly I give and Bequeath unto John Tumbleston's Daughter Elizabeth Sixty dollars to be levied and raised out of my personal Estate and paid to her when she shall come of age, Fifthly I give and bequeath unto my wife Elizabeth all my household furniture one cow and three sheep and grain sufficient for one year and as much as will do her for one year together with the rent of my plantation during her lifetime for her support if she shall need so much to be paid her at the discreation of my Executors as she will need the same. Sixthly, I give and bequeath unto Hugh Shotwell my large Bible and Geography, Seventhly I give devise and Bequeath all the Remainder of my personal Estate (If any there should be after paying the several legacies before mentioned.) and also all my lands and plantations unto William Shotwell and Joseph Shotwell (sons of Hugh Shotwell of the County aforesaid) and the rents thereof after my wife's decease. I do likewise hereby Constitute appoint make and ordain Hugh Shotwell and Alexander Work my executors to this my last will and Testament hereby revoking all former wills by me made. In witness whereof I have hereunto set my hand and seal this twenty sixth day of December in the year of Our Lord One thousand eight hundred and nine. Richard Phillips (seal) In the presence of Edward Jordan William Kirk Fayette Count Sst Reg seal The 23rd day of January Anno Domini 1811 before me the subscriber, Register for the Probate of Wills and granting of Letters of Administration in and for said County personally came Edward Jordan the first signing witness to the foregoing last will and Testament and on his solemn oath did declare that he say the Testator when of right mind sign the same after reading the same in his presence, that no undue influence had been used or later will made by him to his knowledge or belief GivenŠunder my hand and seal the same day Alexander McClean Register (Compared) Fayette County Sst (Reg seal) The twenty eight day of January Anno Domini 1811.
