I Sarah Phillips of Smithfield in the County of Fayette and State of Pennsylvania being of sound mind and disposing memory and considering the uncertainty of this mortal life do make and ordain this my last will and Testament in manner and form following: First I give and bequeath unto my grand Children (heirs of my daughter Margaret Hertzog decd) one dollar in cash each to be paid by my executor. 2nd I give and bequeath unto my daughter Sarah Kendall three hundred dollars. 3rd I give and bequeath unto my grand Children (heirs of my daughter Jane Caldwell decd) one dollar in cash each. 4th I give and bequeath unto my daughter Malinda Phillips five hundred dollars. 5th I give and bequeath unto my son Isaac Phillips three hundred dollars. 6th I give and bequeath unto my daughter Lavinia Patterson Five hundred dollars of my Bank stock of the Bank of Pittsburgh. It is my will that the above named legacies should be paid out of my estate if there should be sufficient, if not then in proportion to said amount of legacies. It is my will and desire that all my personal property such as beds, bedding and household furniture be equally divided among the above named legatees with the exception of the heirs of my daughter Margaret Hertzog decd who I think have heretofore received their share the above division to be made by the said heirs or by some persons whom they may choose. I nominate and appoint David W Patton my Executor of this my last will and testament. I have hereunto set my hand and seal this ninth day of March in the year of our Lord one thousand eight hundred and forty one. Signed sealed and acknowledged by the testator in presence of James M Ocheltra Samuel Kendall Sarah (her mark) Phillips (seal) Fayette County Ss (Register Seal) This 14th day of October Anno Domini 1841 Before me James Piper Register for the Probate of Wills and granting letters of Administration in and for said County personally came James Ochaltra and Samuel Kendall the two subscribing witnesses to the within will who being duly sworn according to law, did depose and say that they were present and saw and heard the testator, Sarah Phillips, sign, seal, publish and declare the within Instrument of writing, as and for her last will and testament and that at the time of doing so, she was of perfect and sound mind, memory and understanding, to the best of their knowledge, observation and belief. That they know of no undue influence used or later will made by the deceased. That they signed the same as Witnesses in the presence of the Testator in the presence of each other, In Testimony whereof I have hereunto set my hand and seal of the Registers office at Union Town, the day and year above written.
