FAYETTE COUNTY, SS: In the Orphans' Court of Fayette county, Pa., In the matter of the partition of the real estate of Isaac Phillips, dec'd, __ of Nicholson, township, Fayette county, Pa., __, March Court, 1864. WRIT OF PARTITION Ellen L. Phillips, (widow) Levina PATTERSON intermarried with Geo. PATTERSON, now deceased. Sarah KENDALL, intermarried with Jeremiah KENDALL, now deceased; the children of Jane CALDWELL, a deceased sister who was intermarried with James CALDWELL, namely: Levina CALDWELL, Sarah CALDWELL, Rachel CALDWELL, William CALDWELL, and Isaac P. CALDWELL; Sarah HERTZOG who was intermarried with was intermarried with Jacob DEFFENBAUGH, William HERTZOG. George L. DEFFENBAUGH, Catharine HERTZOG, intermarried with  Alfred EBERHART, Isaac P. EBERHART, Sarah, intermarried with Jonathan GANS, Margaret, intermarried with Hugh DAVENPORT, and Millice, intermarried with William C. SACKET, Jane HERTZOG died leaving issue four children. to-wit: John W., Hugh, A(rest cut off) and William DAVENPORT, heirs and legal representatives of the said Isaac PHILLIPS, deceased you are hereby notified that an Inquisition will be held, in pursuance of the above mentioned order or writ of partition, upon the premis__ mentioned and described in said writ, on the 4th day of May, 1864, at ten o'clock A. M., __ make partition to and among the heirs and legal representatives, &c., of the said Isaac PHILLIPS as by the law of this Commonwealth is directed if such partition can be made without prejudice to or spoiling the whole; but if such partition cannot be made thereof, as aforesaid, th_ to value and appraise the same according __ law, at which time and place you may attend _ you think proper.
