Will of HENRY RIST Book 2, p. 362 - 1846 I Henry Rist of Tyrone Township, Fayette County, PA do make and publish this my last will and testament hereby revoking all former wills by me at any time heretofore made and touching such worldly estate as it hath pleased God to bless me with, I dispose of the same as follows: First I direct that all my debts and funeral expenses be paid as soon after my decease as possible out of the first moneys that may come into the hands of my Executors. Second it is my will and desire that after the payment of all my just debts the remainder and residue of my estate, real and personal, shall remain in the hands of my beloved wife for the purpose of her support and maintenance and out of it to raise, educate and maintain my younger children. My beloved wife shall have the whole and entire control of all my real and personal estate (after the of my just debts as above) without giving any security for it, and I order that no appraisement of my property shall take place until my youngest child shall be twenty-one years of age, and that is the length of time that I desire my beloved wife to take charge of my estate and at the time when my youngest child (named Martha) shall be of lawful age, my beloved wife and family may continue to live on longer in the same way if they think it is best to do so, if not they may take cause that our intestate laws have laid down and giving my wife her legal dower. My sons each shall receive three hundred dollars more than my daughters when a general distribution takes place. I owe to my son John one hundred and fifty dollars, to my son Abraham fifty for labor done over age. I acknowledge the following named to be my legal heirs, John, Abraham, Benjamin, Joseph, George, Barbara, Catherine, Martha and I do hereby nominate, constitute and appoint my son John Rist to be my Executor to this my last will and testament. In Whereof I, Henry Rist, the testator have hereunto set my hand and seal this thirty-first day of March, A.D. one thousand eight hundred and forty- six. /s/ HENRY REIST (Seal) Signed sealed published and declared by the above named Henry Rist to be his last will and testament in the presence of us, who at his request and in his presence have subscribed our names as witnesses thereunto. Rist Uriah Newcomer (Register's Seal) Fayette County On the 20th day of April A.D. 1846 before me, Joseph Gadd, Register for the probate of wills and granting letters of administration in and for the county of Fayette, personally came John S. Rist and Uriah Newcomer the subscribing witnesses tot he foregoing instrument of writing purporting to be the last will and testament of Henry Rist late of Tyrone Township deceased and being affirmed according to law do depose and say that they were present and saw and heard the testator Henry Rist sign seal pronounce and declare the same as and for his last will and testament and that at the time of so doing, he was of perfect and sound mind, memory and understanding to the best of their observation, knowledge & belief that they knew of no undue influence used or later will made by the deceased & that they signed their names as witnesses in the presence of and at the request of the testator and in the presence of each other.
