Stauffer now living in Tiron Township County of Fayette and State of Pennsylvania being of sound mind and memory and considering the uncertainty of life do constitute this as my Last will and testament in the manor following, to wit: lst I desire that my body be buried decently and which I commit to the Care of God in hope of a glorious resurrection. 2 I desire that after my decease, my Funeral Expenses be paid and all my lawfull debts as soon as possible. 3 I give and bequeath to my dear wife Catherine Stauffer the whole of Farm which I own in East Huntingdon Township, Westmoreland County, containing one hundred and eighty acres more or less to be disposit of as she may think proper. Together with all the household furniture. I also give to her one of her choice of horses and two of her choice of cows. I also give to her five hundred dollars to be raised out of the sale of my personal property or any other monies due me. 4 I give and bequeath to my dear daughter Sarah Kister all my real estate in Tyrone Township, Fayette County. 5 I give and bequeath my son in law, Solomon Kister the whole of the goods in the store after being filled up with the usual stock of goods by regular purchases not including the Notes and book accounts however belonging to it. 6 I give and bequeath two hundred dollars for the building a new Meeting House on Jacobs Crick adjoining the land I gave my wife for the use of the matist (?) 7 I also give and bequeath to the mannoneath (Mennonist?) fifty dollars to expanding (?) their graveyard where my dear children are buried. 8 I desire further that all my lawful debts paid out of the notes book accounts and personal property of all other kinds whatsoever and should;d there be an insufficiency in these to pay said debts and the other bequests I have made, I hereby direct that the balance be paid of the store and should there be any other property of which I may be possessed I give and bequeath the whole to my son in law Solomon Kiester, I hereby appoint Samuel Zuck and Solomon Kiester as the Executors of this my last will. In witness that I do constitute this as my last will revoking all others I subscribe my hand this ninth day of February 1849 In presence of: /s/ John W. Stauffer Joshua Strickler John F. Strickler Fayette Co., (Seal) ....On the 2nd day of March A.D. 1852 before me P. A. Johns Register for the Probate of Wills and granting letters of Administration in and for said county personally came John F. Strickler the second subscribing witness to the above instrument of writing proporting to be the last will and testament of John W. Stouffer late of said County deceased. who being duly sworn according to law doth depose and say that he was present and saw and heard the testator sign seal and pronounce the above as & for his last will and testament and at the time of so doing he was of sound mind, memory and understanding to the best of his knowledge and observation, that he knows of no undue influence used or later will made by the said deceased & that he signed his name as witness at the request and in the presence of the testator.
