Stauffer of the Township of Tyrone, in the County of Fayette and State of Pennsylvania, Yeoman, do make and publish this my last will and Testament, in manner and form following to wit: 1st I devise and it is my wish that my children occupy and posess the farm whereon I now live together untill the youngest child becomes of age and the whole of the proceeds shall belong unto them. And if my sons Martin and Isaac choose to keep the Mountain farm (old entry) attached to the above described plantation, it is my wish that they keep the same, and it is also my wish that they keep the old Eutly farm with a quantitiy of land attached to it as they in their judgment may seem proper to make, to make a sufficient range for pasture and if any land remain not taken by my sons, then the same to be sold and the proceeds divided equally among them, and if at any time there should be a dividend, the the same to be applied for the use of the heirs hereinafter named. And as to my personal property, it is my wish that my children keep all such as farming utensils, stock and house-hold furniture, except such articles as they may think proper to be put to sale. And further when the youngest child shall have attained the age of twenty-one, I give and bequeath unto Martin, Maria, Isaac, Anne and Uriah, share and share alike except Aaron who shall have one and one half share, and as soon as any of my children shall become of age, then it is my wish that they be paid a reasonable recompense for their labour, providing such labor be done on the above premises. It is also my wish that my son Martin shall leave Mrs. Dick line on the Eutly farm, free of rent and pasture for cow, so long as is agreeable to Martin, she still attending to cattle as in my life time, and further it is my will and I bequeath and give unto Maria Two hundred dollars absolutely over and above her equal share for her kindness and attention towards me, which she may have as soon as she may require. And I also empower my Executor hereinafter named with full power to give deed or deeds of conveyance, which deed or deeds I do hereby acknowledge to be as good and valid in law to all intents and purposes as I myself might or could execute the same. And lastly I nominate constitute and appoint my friend Henry D.Overholt of Bullskin Township, to be my Executor of this my last will, hereby revoking all former wills by me made. Overholt Fayette County (Seal) On the 15th day of May A.D. 1849 before me Joseph Gadd Register for the probate of wills and granting letters of administration in and for said County came Martin Stauffer and Henry D. Overhold the subscribing witnesses to the foregoing instrument of writing, purporting to be the last will and testament of A. D. Stauffer late of Tyrone Township deceased and being affirmed according to law did depose and say that they were present and saw and heard the testator A. D. Stauffer sign acknowledge and declare the same as and for his last will and testament, and that at the time of so doing he was of sound mind memory and understanding to the best of their knowledge and belief, that they knew of no undue influence used or later will made by the deceased, that they signed their names as witnesses thereto in the presence of and at the request of the testator and in the presence of each other.
