Will of JOSEPH STRICKLER Will Book 3, p. 39 - 1852 I, Joseph Strickler of New Haven, Dunbar Township, Fayette County, Pennsylvania do make and publish this my last will and testament, hereby revoking and making void all former wills by me at any time made heretofore. FIRST: I order and direct that all my personal estate except such as is hereinafter otherwise disposed of be sold at the discretion of my Executors herein after named and that the proceeds be applied to the payment of my funeral expenses and other just debts. SECOND. I give and bequeath unto my two beloved daughters Harriet Wood (wife of Robert Wood,) and Jane Strickler (who resides with me) my buggy and set of Buggy harness, to be held and possessed by them jointly. THIRD. I give and bequeath unto my aforesaid daughter Jane Strickler one bed and bedding, and two coverlets in addition, (she to have her choice of each). Also my Desk and all the tea ware, plates, knives and forks, spoons and every thing I have that belongs to setting a table. FOURTH. I give and bequeath unto Joseph F. Forrey (son of Daniel Forrey, dec'd.) when he arrives at the age of twenty one years, the sum of two hundred dollars. FIFTH. I order and direct that my farm in Dunbar Township, also my steam mill and lot on which it stands, and all other real estate which I own or have an interest in (except the river Grist mill) be sold by my said Executors hereinafter named at their discretion as to time and whether at public or private sale, and Deeds in fee simple to make, execute and deliver, to the purchaser or purchasers: provided however, if the said Steam Mill property cannot in the opinion of the said Executors, be sold entire to the advantage of my Estate, then I order and direct and hereby authorize them to sell and dispose of the steam-Engine, Burrs and all the mill machinery separately and afterwards to sell and convey the building and lot of ground on which it stands, and the monies arising from the sales of said real estate and mill property I order and direct be applied to the payment of all the judgments against me, except the Judgment in the Common Please of Fayette County wherein Mrs. Ann Bowie is plaintiff, the interest on which I direct to be paid semi-annually, as has been done heretofore. SIXTH. My will and desire is that my share and interest in the river Grist Mill, in New Haven, remain and be carried on as it now is, and I further desire and authorize my Executors to assist in carrying the same on, with the funds of my Estate, so far as they may consider the interest of my said estate will justify them, settlements being made annually and my aforesaid daughters Harriet Wood and Jane Strickler to be paid the sum of Fifth dollars each, annually, out of the profits of said mill, if my share should amount to so much, the same to be paid half-yearly; and when all my debts are paid off, then the whole of the profits of said Mill to be paid to the aforesaid Harriet and Jane, in equal parts, share and share alike, or to their legal heirs, and in the event of either of my said daughters dying without issue, then I will and direct the whole of said profits shall be paid to the survivor of them and her heirs: But if at any time my Executors shall be of opinion that the interest or advantage of my Estate would be best served by the sale of my share and interest in the said Grist Mill property, then I order and direct and hereby empower them to sell and convey the same for such price and upon such terms as they may think best and proper. SEVENTH. After the payment of all my debts (including the Judgment of Mrs. Ann Bowie referred to in item Fifth, ) and subject to the final action and determination of my Executors under and upon the provisions and directions of item Sixth) and the payment of the legacies and bequests herein before set forth. I will and bequeath unto my aforesaid daughters Harriet Wood and Jane Strickler share and share alike all the residue and remainder of my estate, bo be possessed and enjoyed by them and their heirs, provided if either of my said daughters should die without issue or lineal heirs, it is my wish and desire and I order and direct that the survivor of them and her heirs shall take and enjoy the whole of the said residue of my Estate. EIGHTH. The order and directions given to my Executors in Item Fifth as to the sale and disposal of the New Haven Steam Mill property are to be suspended and delayed until the final determination of an action of Ejectment which is now pending for the same, at the suit of the heirs of John Bolton, Deceased and are contingent upon said suit being decided in my favor. NINTH. I hereby make, ordain and appoint my friends, James McIlvaine of Connellsville Township, and Alexander H. Patterson of Dunbar Township Executors of this my last will and testament . A. Johns, Register for the probate of wills and granting letters of Administration in and for said County, appeared Daniel Rogers & Joseph Torrance witnesses to the foregoing instrument of writing purporting to be the last will and testament of Joseph Strickler late of said county deceased who being duly sworn according to law doth depose and say that they were present and saw and heard the testator sign, seal and deliver & pronounce the same as and for his last will and testament and that at the time of so doing he was of sound mind memory and understanding to the best of their knowledge and belief - that they knew of no undue influence used or later will made by the testator and that they signed their names as witnesses thereto at the request and in the presence of said testator & in the presence of each other.
