Burkholder Harner Hagerstown, Maryland Greeting: WHEREAS at an Orphans' Court, held at Chambersburg, in and for the County of Franklin, on the 31st day of July in the year of Our Lord one thousand nine hundred and Thirty-Seven, before the Honorable Watson R. Davison, President Judge of the said Court, THE PETITION of Emma S. Burkholder was presented, setting forth, that Caroline Burkholder died October 20, 1919, a resident of Antrim Township, Franklin County, Pennsylvania, intestate, and letters of administration on said estate were duly granted to Hays Burkholder. That Thomas Haldaman and wife by Deeddated [sic] April 23, 1909 and recorded in Deed Book of Franklin County, Vol. 196, Page 331 conveyed to Caroline E. Burkholder, Henry Clayton Burkholder and Hays Burkholder as tenants in common, two certain Tracts of land lying and being situate in Antrim Township, Franklin County, Pennsylvania, containing one hundred and twenty-eight (128) acres and one hundred and twenty-Two (122) perches, adjoining lands formerly of Abram Crunkleton, the Conococheague Creek, lands formerly of Henry Hawbaker and David Mowen, and lands formerly of Joseph Whit- more and Rebecca Rawlings' heirs, more particularly described by meets and bounds in the aforesaid deed, and that Caroline E. Burkholder named in said Deed is the decedent in these preceedings, and that the said dedecent at the time of her death was seized of an undivided one-third (1/3) interest in said real-estate. That the only liens against this property to the knowledge of your Petitioner are taxes tue [sic] on said real estate and inheritance tax due the Commonwealth of Pennsylvania. That the heirs of Caroline Burkholder, the decedent with their address are as follows: Hays Burkholder Greencastle, Pa. R.R. H. Clayton Burkholder Greencastle, Pa. R.R. Alice Burkholder Greencastle, Pa. R.R. Carrie Daley Greencastle, Pa. R.R. Katie Shank Charlton, Maryland Frank Burkholder Greencastle, Pa. R.R. Edward Burkholder " " Jacob Burkholder Millersville, Illinois and another son, William A. Burkholder, who died June 14, 1935, leaving a last will and testament dated August 24, 1916, probated June 21, 1935, and recorded in Will Book of Franklin County Vo. 32, Page 73, in and by which will, he appointed Emma S. Burkholder widow, as Executrix and gave her a life estate in his estate, and provided that at her death his estate shall be divided among his three children, namely: -- William A. Burkholder, Jr. Chambersburg, Pa. R.R. Clifford M. Burkholder Dundalk, Md. Clover I. Burkholder now Harner Hagerstown, Md. That all of said parties to the best of your petitioner's knowledge sui juris, and the addresses are as above state. That the parties above named are all the parties in interest in this estate. That no partition or valuation of said real estate has been had. WHEREFORE, the Petitioner respectfully prayed that a citation be awarded, di- rected to all parties in interest to show cause why an inquest in partition should not be awarded, WHEREUPON THE COURT made the following order: Now, July 31, 1937, upon consideration of the within petition, a citation is awarded, directed to Hays Burkholder, H. Clayton Burkholder, Alice Burk- holder, Carrie Daley, Frank Burkholder, Edward Burkholder, William A. Burk- holder, Jr., Emma S. Burkholder, Executrix of the last will and testament of William A. Burkholder, deceased, to show cause why an inquest in partition should not be granted, said citation to be served personally, and a citation is awarded directed to Katie Shank of Charlton, Maryland, Jacob Burkholder of Millersville, Illinois, Clifford M. Burkholder, Dundalk, Maryland, and Clover I. Burkholder Harner of Hagerstown, Maryland, to show cause why an inquest in partition should not be granted, said citation to be served personally upon the parties living in Franklin County and to be served by registered mail at least ten (10) days prior to the return day of said citation, and said citation to be returnable to the Orphans' Court of Franklin County on the 11th day of Sept. 1937. Millersville, Illinois could, possibly, be Milledgeville which is in Carroll Co. although there is a Millersville in Christian Co., IL.
