All rights reserved. http://www.usgwarchives.net/copyright.htm http://www.usgwarchives.net/pa/franklin/ _______________________________________________ Franklin County, PA Volume D, p. 144: The Petition of John Secrist & John Lehman and Mary his wife heirs of Solomon Secrist late of Quincy Township decd was read and setting forth that said Solomon Secrist died in the month of February Eighteen hundred and thirty eight leaving to survive him three children viz. John, Mary intermarried with John Lehman your petitioner Martha intermarried with George Fry who died since her father leaving to survive her her husband the said George Fry and eight children all minors viz. John, Jacob, George, Catharine, Simon, Solomon, William and Andrew Fry none of whom have Guardians. That said intestate died seized in his demesne as of fee of two tracts of land situate in Quincy Township aforesaid the mansion tract is bounded by lands of James McCoys heirs John Benedick Samuel Frederick and John Small containing thirty nine acres and one hundred and twenty six perches and allowance with a story and a half log house and log barn thereon erected also a fine spring of water on the land also of another small piece of land situate in said Township bounded by lands of George Cook Senr. John S. Secrist John Small and John Secrist containing fourteen acres and Eighty two perches and allowance the greater part of which is cleared that your petitioners are desirous of having their shares in severally & therefore pray said court to award an inquest to part and divide said real Estate to and among all of said heirs and legal representatives if the said can be done without prejudice to and spoiling the whole and if said land cannot be so parted and divided, to part and divide it by metes and bounds to and among as many of said heirs as it will accommodate without prejudice to and spoiling the whole and to well and truly Value and appraise each purpart and if the said land cannot be parted and divided to accommodate more than one of said heirs to value and appraise the same undivided and make inquisition & return thereof to said Court. 17th November 1838. The court directed the within Petition to be amended by stating Henry Beaver Esq. Is Guardian of John, Jacob, George and Catharine Fry within named and that Henry Shoemaker is Guardian of Simon, Solomon, William and Andrew Fry within mentioned minor children of Martha Fry decd. Whereupon the Court did direct that the Sheriff in his proper person with twelve free honest and lawful men of his Bailiwick do hold an inquest on the aforesaid and divide or value the same according to the prayer of the petitioners and make return thereof to said Court.
