We encourage links to the state and county table of contents. ____________________________________________________________ Franklin County, PA Articles of Agreement, Book 13, p. 304-305: (Detailing arrangement between Joseph Dull of Washington Twp. and his wife "Dorotha" and their son Jacob Dull) Articles of agreement Indented made concluded and agreed upon the fifteenth day of January in the year of our Lord one thousand Eight hundred and twenty three between Joseph Dull of Washington township in the County of Franklin & State of Pennsylvania of the one part and Jacob Dull son of the said Joseph Dull of the same place of the other part as follows to wit the said Joseph Dull for the consideration hereinafter mentioned doth for himself his heirs Executors and Administrators covenant promise grant and agree to and with the said Jacob Dull his heirs and assigns by these presents that he the said Joseph Dull shall and well on or before the first day of April next ensuing the date hereof at the proper costs ad charges of the said Joseph Dull his heirs and assigns by a deed or deeds of conveyance, well and sufficiently grant and convey and assure unto the said Jacob Dull his heirs and assigns in fee simple clear of all incumbrances all that Plantation or farm on which the said Joseph Dull now lives containing about one hundred acres situate in the township of Washington County & State aforesaid the above farm is in two separate tracts part being cut off by land the said Joseph Dull sold to David Mann and Daniel Dull said part adjoining lands of William Knepper, George Cook & David Morlar the old tract joining lands of the said Joseph Dull sold to Thomas Rock & Daniel Dull and also joining lands of John Riker, George Lydig* & others together with all and singular the buildings improvements and other the premises hereby demised* with the appurtenances In consideration whereof the said Jacob Dull for himself his heirs executors and Administrators doth covenant promise and agree to and with the said Joseph Dull his heirs and assigns by these presents that he the said Jacob Dull his heirs executors and administrators or assigns the sum of thirty dollars per acre with the usual allowance of Roads &c, in manner following seventy three Dollars & ninety six cts at this present time and one hundred dollars more on the first day of April next and then annually one hundred dollars till the whole is paid it is also agreed that the said Joseph Dull & his wife Dorotha shall have the privilege of living in the house they now live and the said Jacob Dull must find them the said Joseph Dull & Dorotha his wife half as much wheat as they may want and half as much of the following articles as they always stand in need of Viz feed for two cows one horse pasture for two cows and one horse Beef & Pork for themselves fire wood hauled to their house all during their life and if the said Dorotha should outlive her husband then the said Jacob Dull must find her the half of the above during her life And for the true performance of all and every the covenants and agreements aforesaid the said parties bondeth himself his heirs executors and administrators unto the other his executors Administrators and assigns in the penall sum of six thousand Dollars firmly by these presents In Witness whereof the said Parties to these presents have hereunto set their hands and seals the day & year first above written. Foreman Received January 15th, 1823 of Jacob Dull Seventy three dollars & ninety six cents in full for the first payments of the within Joseph "his mark" Dull Franklin County SS. Jacob Fisher of said County being duly sworn in open court doth depose and say that the name Jacob Fisher set as a witness to the within article of agreement is of his own hand writing that this deponent was present at the execution of said Article and did see the said Joseph Dull and Jacob Dull parties to the said Articles sign seal and deliver the same as their act and deed and that this deponent did at the same time write his name thereto as a Witness and did also see the other subscribing witness sign his name thereto as such - sworn in Court this 29th day of April 1823 Jacob Fisher April 30th, 1823 Sworn & subscribed in open Court John Shryock* Prothy. And now April 29th 1823 upon Examination of one of the Witnesses in open Court the court being satisfied of the truth of the fact stated in the Petition presented do adjudge the proof of the contract sufficient and direct this adjudication to be endorsed certified by the Prothonotary under his hand and seal of office and the same to be recorded in the recorders office for the County of Franklin: Therefore I John Shryock Prothy of the County aforesaid do certify agreeably to the order of our court that the original Petition with the order of the court thereon as filed in my office In Testimony whereof I have hereto set my hand and the seal of said Court at Chambersburg this 9th day of June 1823 John Shryock, Prothy A true copy taken from the original this 5th day of July A.D. 1823.
