We encourage links to the state and county table of contents. ____________________________________________________________ Franklin County Deed Book 12, page 89: [asterisks *** indicate unclear words or portions of words] [14 July 1818 John Toms, grantor; Joseph Dull, grantee] This Indenture made this fourteenth day of July in the year of our Lord, one thousand eight hundred and eighteen between John Toms of Washington township, Franklin county and commonwealth of Pennsylvania of the one part, and Joseph Dull of the township of Washington county of Franklin and commonwealth of Pennsylvania of the other part. Witnesseth, that the said John Toms for and in consideration of the sum of one hundred dollars, current money of the commonwealth of Pennsylvania, to him, the said John Toms, in hand paid by the said Joseph Dull before the **ling and delivery of these presents, the receipt whereof he, the said John Toms doth hereby acknowledge, and therewith being fully satisfied and content, hath granted, bargained, sold, ali**ed, en*co**ed and confirmed; and by these presents, doth grant, bargain, sell, ali*n, ***** and confirm unto the said Joseph Dull his heirs and assigns, all that lot No. 69 situate, laying, and being in the town of Franklin, Washington township, and county of Franklin and commonwealth of Pennsylvania, aforesaid, the said lot No. 69 being situate on the East side of the cross-street, and known and distinguished in the general place of said town, by lot No. 69 which plan is recorded at Chambersburg, in the office for recording of deeds, in and for the county of Franklin, in book ___ page ___ the said lot No. 69 being bounded and limited as follows, beginning at a store standing on the cross-street, and thence by and with a twelve foot alley South sixty two and a half degrees East fifteen perches to a twelve foot alley, thence North twenty seven and a half degrees East five perches to lot No. 70 ***** north sixty two and a half degrees West fifteen perches to the Cross street aforesaid thence south twenty seven and a half degrees West five perches to the beginning, containing 75 square perches of land, the same being part of a tract of land called Toms-town, which the commonwealth of Pennsylvania by patent, dated the seventeenth day of December in the year of our Lord, one thousand, eight hundred and five did grant and convey to John Toms the father of the said John Toms, party hereto, which patent is enrolled in the rolls office, in patent book No 56 page 167. And whereas the said John Toms sen. died intestate, and the said tract of land, called Toms-town, was divided into three purports, of which purport No. 2, and purport No 3, became vested in the said John Toms, party hereto, his heirs and assigns forever, on which said purport, No. 2 and No. 3, the said town of Franklin is laid out. Now know we, that the said John Toms, party hereto, for and in consideration of the above mentioned sum hath granted, bargained, and sold, all that lot, No. 69 as above described, to the said Joseph Dull his heirs and assigns forever (subject, nevertheless, to the yearly ground rent of one dollar to be paid to the said John Toms, proprietor of said town of Franklin, or to his heirs or assigns, on the first day of June in each and every year, forever Together with all and singular the buildings and improvements thereon, and thereunto belonging, or in any wise appertaining, with their and every of their appurtenances, unto the said Joseph Dull his heirs and assigns forever, and to and for no other use, intent or purpose, whatsoever; and the said John Toms, for himself and his heirs, executors and administrators, doth hereby covenant, grant, promise and agree to and with the said Joseph Dull his heirs, executors, administrators or assigns, that he, the said John Toms and his heirs, the said lot, No. 69 as above described, with the appurtenances thereunto belonging to the said Joseph Dull his heirs and assigns against him, the said John Toms, and his heirs, and against all and every person or persons whomsoever, claiming or to claim any right, title or interest, in and to the said lot No. 69 or any part thereof, the said John Toms and his heirs, shall and will warrant, and forever defend,k by these presents. Before me the subscriber one of the Justices of the peace, in and for the county of Franklin, personally came John Toms, party grantor mentioned in the foregoing deed, and acknowledged the same to be his act and deed to the intent that the same be recorded as such.
