Koons Location of Property: Waynesboro Consideration: $1,080 This Indenture made the 7th day of December in the year of our Lord one thousand nine hundred and one, Between Harvey H. Koons, Administrator of all and singular the goods and chattels, rights, and credits which were of Samuel Koons late of the Borough of Waynesboro in the County of Franklin and State of Pennsylvania deceased, of the one part, and Charles A. Koons of the Bor. Of Waynesboro, Co. of Franklin and State Pa. of the other part: Whereas, the said Samuel Koons in his lifetime and at the time of his death, was seized in his demise as of fee and in a certain property situate in the Borough of Waynesboro in the County of Franklin and Sate of Pennsylvania and containing forty-seven (47) perches, and whereas, Letters of Administration of all and singular the goods and chattels, rights, and credits which were of the said Samuel Koons at the time of his death, were in due form of law committed unto the said Harvey H. Koons and Whereas, the said Administrator, at an Orphans Court, held at Chambersburg in and for Franklin County and State of Pennsylvania, presented a petition setting forth that the personal estate of said Samuel Koons was insufficient for the payment of his debts, an inventory of all personal property and a just and true account of all debts, and also a statement of all the real estate of said decedent, was thereto attached; and praying said Court to order the sale of so much or such part of the said real estate as to the Court should appear necessary for the purposes aforesaid. Whereupon, it appearing manifest unto the Court aforesaid, that the personal estate of the said Samuel Koons was not sufficient to pay his debts, it was considered and ordered by the said Court, on the 12th day of December A.D. one thousand eight hundred and ninety eight that the real estate hereinafter described be sold, according to the prayer of the petitioner: And whereas, in pursuance of the said order, and by force and virtue of the laws of this state in such case made and provided, afterwards to wit, on the 19th day of October A.D. 1901, the said Harvey H. Koons did expose the said hereinafter described real estate to sale at public venitue or outcry, after giving notice thereof according to law and sold the same unto the said Charles A. Koons for the sum of Ten hundred and Eighty Dollars ($1,080) he being the highest bidder, and that the highest and best price bidden therefore, which sale, on report thereof made to the Judges of the said Court, on the 2nd day of December A.D. 1901, was confirmed and it was considered and adjudged by the said Court, that the same should be and remain firm and stable forever; and good and sufficient security, approved by the said Court, for the faithful application of the proceeds of sale, has been duly entered as by the records of said Court more fully and at large appears; Now this Indenture Witnesseth, that the said Harvey H. Koons, Administrator as aforesaid, for and in consideration of the sum of Ten Hundred and Eighty Dollars ($1,080) to him in hand paid by the said Charles A. Koons, at and before the ensealing and delivery hereof, the receipt whereof is hereby acknowledged has granted, bargained, sold, aliened, enfeoffed, released and confirmed and by these presents does hereby grant, bargain, sell, alien, enfeoff, release and confirm unto the said Charles A. Koons his heirs and assigns All the following described real estate lying and being situate in the Borough of Waynesboro, County of Franklin, and State of Pennsylvania, bounded and limited as follows, to wit: Beginning at a stake twenty feet east of the center of line of Geiser Co. R.R. on the South side of Fifth Street of said borough thence South fifty and one-half degrees East forty feet thence South forty and one fourth degrees West two hundred and eight feet to a stake at the North side of a reserved alley way thence North fifty and one half degrees West eighty five feet to a stake, thence North fifty two and one fourth degrees East two hundred and fourteen and one half feet to the place of beginning. Containing forty-seven (47) perches neat measure. Being the same property which D.W. Hess and wife by deed bearing date March 31, 1897, recorded in Franklin County Deed Book Vol. 108, page 344 conveyed to Samuel Koons decedent herein mentioned. Together with all and singular the ways, waters, watercourses, rights, liberties, privileges, hereditaments and appurtenances whatsoever thereunto belonging, or in anywise appertaining and the reversions and remainders, rents, issues and profits therof; and also all the right, title, interest, property claim and demand whatsoever, of the said Samuel Koons in his lifetime, at and immediately before the time of his decease, in law, equity or otherwise howsoever, of in and to or out of the same; To have and to hold the said hereitance unto and premises hereby granted, or mentioned and intended so to be, with the appurtenances, unto the said Charles A, Koons his heirs and assigns forever. And the said Harvey H. Koons does covenant, promise, grant and agree to and with the said Charles A. Koons, his heirs and assigns, by these presents, that he said Harvey H. Koons has not done, committed, or knowingly or willingly suffered to be done any act, matter or thing whatsoever, whereby he premises aforesaid, or any part thereof, is, are, shall or may be charged or incumbered, in title, charge or estate, or otherwise howsoever.
