All rights reserved. http://www.usgwarchives.net/copyright.htm http://www.usgwarchives.net/pa/franklin/ _______________________________________________ Written: October 12, 1788 Recorded: August 15, 1793 This Indenture made this ninth day of October in the year of our Lord one thousand seven hundred & eighty eight Between Stephen Mowan, John, Baltzer, Ludwick, Daniel & Peter Mowan and Elizabeth Hartley, Catherine Stuff and Mary and Molly Mowans of the one part and George Mowan of the other part. Whereas a certain Daniel Mowan decd. was possessed of a certain tract of land a plantation in Antrim Township & Now in Franklin County & State of Pennsylvania whereon he dwelt in his life time and by his last will & testament made the eighth day of April 1786 and now remaining in the Registrars office in Chambersburg he did give and bequeath unto his ten children before named the grantors all his real estate in the following words viz~ Item to my son Stephan, John, Baltzer, Ludwick, Daniel & Peter & to my Daughter Elizabeth Hartley, Catherine Stuff & Mary & Molly Mowan I give and bequeath all my estate both real & personal to be equally divided amongst them after the decease of my said wife Catherine & the decease of my son George to each an equal share, share & share alike as by reference being had to said will, will more fully appear Now this Indenture witnesseth that the said Stephen, John, Baltzer, Ludwick, Daniel & Peter Mowan, Peter Hartley & Elizabeth his wife Nicholas Stuff & Catherine his wife, Caspar Huppengardner & Mary his wife (formerly Mary Mowan) and Molly Mowan for and in consideration of the sum of twenty five pounds specie to each of the subscribers hereunto paid by George Mowan the receipts whereof is hereby acknowledged they have granted bargained & sold aliened released & by these presents have grant bargain and sell alien release and confirm each of us the subscribers hereunto one tenth part of all our deceased father’s Real estate in Antrim Township aforesaid as by him willed & bequeathed to us in his last will and Testament, with all our estate right title Interest property and claim of in and to the farm as undivided use to the said George Mowan his heirs and assigns To have and to hold the same with the improvements & buildings thereon and the appurtenances Herediments & priviledges thereon or thereunto belonging or in any wise appertaining to and for the only proper use benefit and behoof of the said George Mowan his heirs & assigns for ever, and we the said Stephen, John, Baltzer, Ludwick, Daniel & Peter Mowan and Peter Hartley & Elizabeth his wife, Nicholas Stuff & Catherine his wife, Casper Huppingardner & Mary his wife and Molly Mowan for themselves and their heirs do hereby these presents promise Covenant & engage each of these for themselves that have hereunto subscribed & for their heirs to warrant 7 defend each of them their shares Interest and claim of and into their deceased fathers real estate aforesaid unto the said George Mowan his heirs & assigns for ever from all persons whatsoever that now or hereafter may lay lawful claim thereunto the Commonwealth of Pennsylvania for the purchase money & Interest now due & to become due on the same only accepted In witness whereof we have hereunto severally set our hands & seals the day and year first written within. his his Stephan Mauen (seal), John “X” Mowan (seal), Baltzer “O” Mowan (seal) mark mark his his Ludwick "T" Mowan (seal) Daniel Mowan (seal) Peter “O” Mowan (seal) mark mark his her Casper “I” Huppingardner ( seal) Mary “E” Huppingardner mark mark her her Elizabeth “+” Hartley ( seal) (seal) (seal) (seal) Molly “U” Mowan mark mark Sealed & delivered in presence of Fridrich (?) Henderson Margaret Henderson Franklin County SS} Personally appeared before me the subscriber one of the Justices in and for said County Elizabeth Hartley and acknowledged the within conveyance unto George Mowan as her act and deed for the purposes therein mentioned and desires the same may be recorded as such. Franklin County SS} Before me the subscriber one of the Justices & for said County personally appeared the within named Stephen Mowan John Mowan Baltzer Mowan Ludwick Mowan Daniel Mowan Peter Mowan Casper Huppingardner & Mary Huppingardner his wife and Molly Mowan and acknowledged the within Indenture unto George Mowan as their act and deed and desired that the same may be recorded as such as witness my hand and seal this 25th of December 1792 Tho. Crawford Recorder Additional Comments: Franklin County Deed Book 3:33, County Recorders office, Chambersburg, Pennsylvania. et al: John Mowan, Baltzer Mowan, Ludwick Mowan, Daniel Mowan, Peter Mowan, Casper Huppingarder & wife Mary, Peter Hartley and wife Elizabeth, Nicholas Stuff & wife Catherine, Molly Mowan. The signature of Stephen Mowan appears in Gothic German handwriting and the surname is spelled "Maüen". Peter Hartley, Nicholas Stuff and his wife Catherine did not sign this deed and gaps were placed where their signatures should have appeared.
