All rights reserved. http://www.usgwarchives.net/copyright.htm http://www.usgwarchives.net/pa/franklin/ _______________________________________________ Lot # 52, Mercersburg Written: February 26, 1859 Recorded: April 12, 1859 This Indenture, made the twenty sixth day of February in the year of our Lord, One thousand Eight Hundred and fifty nine between John Myers of Montgomery Township and Samuel Alexander and Catherine his wife of Peters Township Franklin County and State of Pennsylvania of the first part and Frederick C. Weidlich of the Borough of Mercersburg County and State aforesaid of the second part. Witnefseth That for and in consideration of the sum of Nine hundred dollars, lawful money of the state aforesaid, to them in hand will and truly paid by the said party f the second part at and before the ensealing and delivery hereof the receipt whereof is hereby acknowledged have granted, bargained sold and sold, aliened enfcoffed and confirmed and by these presents do grant, bargain and sell alien, enfcoff and confirm unto the said party of the second part his heirs and afsigns all the following described Real Estate lying and being situated in the Borough of Mercersburg, County and State aforesaid to wit; all that certain lot of ground known in the general plan of said Borough of Mercersburg as Lot number fifty two (52) bounded on the North by a Crofs street on the East by an alley on the South by a lot of Jacob B McCune, and on the West by the Main Street of said Borough fronting fifty feet on said main street and running back one hundred and ninety feet in depth and on which in erected a two stoned brick dwelling house and other buildings; being the same lot of ground which Nicholas Fleming, formerly Sheriff of Franklin County sold as the property of John Johnston, deceased, and sold to Henry Spangler as appears by the said Sheriff's deed dated the 25th day of November A.D. 1825 and which the said Spangler afterward sold and conveyed to William Van Dyke by deed dated the 17th day of August A.D. 1831 and which by virtue of sundry good and sufficient conveyances and assurances in law duly had and executed became vested in Joseph Myers who being there-of seized in fee simple, died intestate by virtue of which and of the laws of the Commonwealth of Pennsylvania relating to intestates estates, the title to the same became vested in the heirs at law of the said Joseph Myers deceased all of whom (except the said Catherine Alexander and Samuel Alexander her husband) did subsequently by virtue of sundry good conveyances and assurances in law duly had and executed, convey their said several interests in the same to John Myers, one of the said heirs who together with the said Catherine Alexander and Samuel Alexander her husband are now the sole owners, and parties hereto, references being had to the said several conveyances and assurances will more fully and at large appear Together with all and singular the buildings and improvements thereon made or erected profits and commodities advantages, emoluments, hereditaments and appurtenances whatsoever to the said described real estate belonging or in anywise appertaining and the reversions remainders, rents, issues and profits thereof; also all the estate right title interest, use, possessions property claim and demand whatsoever of them the said party of the first part in law or Equity or otherwise however of, in, to or out of the said described Real Estate belonging or in any part thereof saving and excepting the payment of the annual quit rent of one dollar and thirty three and one third cents payable to the heirs of William Smith deceased. To Have and To Hold the said Real Estate as before described and the premises hereby granted maintained or intended so to be with the appurtenances unto the aforesaid party of the second part his heirs and afsigns forever to his and their only proper use benefit and behoof and to and for no other use, intent, meaning or purpose whatsoever, saving and excepting as aforesaid the annual quit rents of one dollar thirty three and one third cents payable to the heirs of the original proprietor William Smith deceased on the twenty third of March in each and every year. And the said party of the first part for themselves and their heirs covenant, grant, and agree to and with the said party of the second part his heirs and afsigns by these presents that they the said party of the first and their heirs the before described real Estate hereby granted bargained and sold with the appurtenances unto the said party of the second part his heirs and afsigns against them the said party of the first part and their heirs and all other persons whomsoever legally claiming or to claim the same or ant part thereof shall and will warrant and forever defend. In Testimony whereof the said party of the first part have hereunto set their hands and affixed their seals the day and year first above written Sealed and delivered in the presents of John Myers {L S} G W Wolf Catherine Alexander {L S} P A Rice Samuel Alexander {L S} Received on the day of the above Indenture of the therein named Frederick C. Weidlich the sum of Nine Hundred dollars in full for the consideration money above mentioned John Myers Witness G W Wolf } Catherine Alexander P A Rice } Samuel Alexander Pennsylvania Franklin County SS. Before me a Justice of the Peace in and for said County personally appeared John Myers, Catherine Alexander and Samuel her husband and acknowledged the above Indenture to be their act and deed and expressed a desire that the same as such be lawfully recorded. The said Catherine Alexander being of full age and having had the contents of said deed made known to her, separate and apart from her said husband, did upon such separate examination declare that she did voluntarily, and of her own free will and accord, sign and seal and as her act and deed deliver said Deed of Conveyance without any coercion or compulsion whatsoever of her said husband.
