All rights reserved. http://www.usgwarchives.net/copyright.htm http://www.usgwarchives.net/pa/franklin/ _______________________________________________ Source: Franklin Co., Pa Will Book D, Pages 2-3 Written: October 6, 1826 Recorded: April 9, 1827 In the name of God Amen, I, Nicholas Bunn of Franklin County and State of Pennsylvania being weak in body and of Sound mind, memory & understanding but considering the uncertainty of this transitory life, do make & publish this my last will & testament in manner and following, to Wit: First it is my will, and I do order that all my just debts and funeral expenses be duly paid and satisfied as soon as conveniently can be after my decease. Item. I give and bequeath unto my dear wife Rosanna two beds, one cupboard, one chest, one stove, one kitchen dresser, one copper kettle, two pots, 2 cows, four sheep & one horse. Item - I give & bequeath unto my son Peter Sixty dollars to be paid to him out of the first monies that can be raised. Item – I give & bequeath unto my daughter Margaret one saddle, one spinning wheel and one horse. And as touching the rest of my Estate real & personal, it is my will that the personal is not to be sold until next Spring and what grain shall be on hands remaining, my wife shall have to her use Except the rye, my land is to be sold by my Executor herein after named at any time after my decease my legal representatives are all agreed to have it sold, and in case any of them disagreeing in a sale then it is to be leased until my wife’s decease, and my wife is to have the rents for her support & is case she shall not need it all the remainder is to be equally divided among my children, and if my legal representatives should prefer a Sale of the land, for that purpose. I do hereby authorize and empower my said Executor or the survivor of him to sign, seal, execute & acknowledge all such deed or deeds of conveyance as may be requisite & necessary for the granting & assuring the same to the purchaser or purchasers thereof in fee simple, and out of the monies arising from such sale my wife is to have her dower at common law, and the remainder to be equally divided among my children, my son John’s children to have one share, and in case my son David is desirous to farm my Plantation, in that case it is my will that he shall two sets of horse gears & two bridge bands, one plough & harrow, my is to be at the whole expence cutting the next harvest and lastly, I nominate, constitute & appoint my son Peter Bunn to be Executor of this my will, hereby revoking all other wills & declaring this & none other to be my last will & testament. In witness whereof, I have hereunto Set my hand & seal this sixth day of October one thousand eight hundred & twenty- six. Nicholas Bun {Seal} Signed & Sealed in presence of us: John Divelbiss & Michael Cook, Jr. Franklin County ss On this 9th April 1827 appeared before me Register for said County Michael Cook, Jr. one of the witnesses to the within instrument of writing who being duly affirmed doth depose & say, that he was present & saw Nicholas Bun, now deceased, write his name unto & heard him publish the same as & for his last will & testament, that at the time of doing thereof, he the said decd, was of sound & disposing mind memory & understanding according to the best of his knowledge & belief and that he also saw John Divelbiss the other witness sign his name thereto as such. Michael Cook, Junr. Affirmed & Subscribed before John Findlay, Junr. Regr Franklin County ss On this 17th April 1827 appeared before me Register for said County John Divelbiss one of the witnesses to the within instrument of writing who being duly Sworn doth depose & say that he was present and saw Nicholas Bun now decd write his name unto and heard him publish the same as & for his last will & testament that at the time of doing thereof the said decd was of Sound & disposing mind memory & understanding according to the best of his knowledge & belief and that he also saw Michael Cook, Junr write his name thereto as a witness. John Divelbiss Sworn & Subscribed before John Findlay, Junr Regr 17 April 1827 Executor affirmed well & truly to Execute this will file Inventory & Settle an account in the year or when legally required – and diligently & faithfully to regard & well & truly to comply with the provisions of the act passed 7 April 1826 entitled an act relating to collateral inheritances. John Findlay, Junr Regr Book D, page 249 18th January A.D. 1833 Letters of Administration de bonis non with the will annexed of Nicholas Bun late of Franklin County deceased were granted to Michael Cook with Jacob Zimmerman & William Bowers as his surety having executed a bond in the sum of three thousand dollars according to law – same day Michael Cook affirmed well and truly to administer the goods & chattels, rights & credits of said deceased (not administered on by the former executor & administrator) according to law - - And also will diligently & faithfully regard & well & truly comply with the provisions of the law relating to collateral inheritances. 18 January 1833 before Paul I.
