The submitter has given permission to the USGenWeb Archives to store the file permanently for free access. ___________________________________________________________ Franklin County Wills Vol. A, Page 308 Transcribed exactly (with original spelling) by Gordon Jones from a copy supplied by SAMPUBCO 1793 Will of Robert Elder, Franklin County, PA In the Name of God amen this twenty seventh day of November in the year of our Lord one thousand seven hundred and Ninety three Robert Elder of Pennsylvania in the County of Franklin being sick and weak in body but in Perfect Mind and memory thanks be given to God therefor and calling to mind the Mortality of my Body and knowing that it is appointed for all men once to die Do Make and ordain this my last will and Testament that is principally and first of all I give and Recommend my Soul to God that gave it and for my Body I Recommend it to the Earth to be Buried in a Christian manner at the Discretion of my Executors nothing Doubting but at the General Resurrection I Shall Receive the same again by the almighty power of God and trusting such worldly goods wherewith it hath pleased God to bless me in this life I give and dispose of the same in the following manner and form. Item I allow yt [sic?] Expences of my funeral to be taken of the whole, Item I allow the movable property to be sold at Publick Vendue as soon as Convenient Except the Beding and such part of the Household furniture that cannot be spared Item I allow my beloved Wife Hannah her first choise of one Bed and Bed close and her full third of the Estate personal and Real after the Debts are paid, the debts to be paid of the personal Estate, after the Debts are all paid the Remainder is to be Divided only my daughter Isabel is to have a Bed and Beding and her Saddle so the Rest is to be Divided equally among the four Children Except Rob't is to have ten pounds more than the Rest Item I allow the Land to be sold as soon as Opportunity will serve and if the cannot sell the Land the are to Let it out upon Rent till the Have an opportunity of Selling or if Hannah Elder his beloved wife thinks proper - She may keep it in her own Hand till it can be sold, Item I allow the Horse Creatures not to be sold Except the see cause, Item I allow the Boys to be put to trads if the think proper themselves, Item I constitute and allow William Elder Esq. and Hannah Elder Execut'rs of this my last Will Testament to see the same Ratified and fullfilled. I do hereby willingly Disallow Rev[unclear] and Disannull all and every former will and Testament by me at any time made constituting this and no other to be my Last will and Testament.--- In Witness whereof I set my Hand and seal the Day and year above Written.--- Robert Elder (Seal) Being Present - William Withrow James Withrow Franklin County to wit. On the 5th September 1794 William Withrow & James Withrow to the above writing appeared before me the Subscriber Register for the probate of Wills & granting Letters of Administration in & for the said county and on their solomn oaths deposeth & saith that they were personally present & saw & heard Robert Elder aforesaid now dec'd write his name unto and seal & publish the above writing as & for his last will & Testament & that at the time of doing thereof he the said Robert was of sound & disposing mind memory and understanding according to the best of their knowledge & belief & that their names signed thereto as witnesses is of their own Signed writing done at the same time. - William Withrow Sworn & subscribed before James Withrow Edw Crawford
