PA, probated 1849 In the name of God, Amen, I Joshua Philips of Warren Township Franklin County and State of Pennsylvania, being in perfect health of body and of sound mind, memory and understanding, but considering the uncertainty of this transitory life do make and publish this my last Will and Testament in manner and form following, to wit: First, it is my Will and I do order that all my just debts and funeral expenses be duly paid and satisfied as soon as conveniently can be after my decease. Item. I give and bequeath unto my dear wife Anna one bed, two cows, together with such of my household furniture and kitchen utensils as she may choose to keep for her own use. Item, I give and bequeath unto my said wife the one third of the income from my farm during her life time, and to have the privilege of residing in my dwelling house during her life. Item. I give and devise unto my son Joshua all my plantation, he paying thereout unto my other children herein after named the several sums of money to them respectively bequeathed. I also give and bequeath unto my said son Joshua my horses, horse gears and waggon, together [with] all my farming utensils and my gun. Item. I give and bequeath unto my son Thomas one hundred and fifty dollars to be paid to him three years after my decease. Item. I give and bequeath unto my son William eighty dollars. Item. I give and bequeath unto my daughter Catharine eighty dollars and one bed. Item. I give and bequeath unto my daughter Eleoner Johns, in the State of Ohio, eighty dollars. Item. I give and bequeath unto my daughter Sarah eighty dollars and one bed. Item. I give and bequeath unto my daughter Elizabeth Akers, eighty dollars. Item. I give and bequeath unto my daughter Anna Akers, eighty dollars. Item. I give and bequeath unto my grand daughter Jemima Evans fifty dollars and one bed. And as touching the remainder of my stock such as cattle, sheep and hogs, and all the household and kitchen furniture, after my wifes decease to be equally divided between my son Joshua, daughters Catharine, and Sarah, and grand daughter Jemimah Evans. And lastly, I nominate constitute and appoint my son Joshua to be sole Executor of this my Will, hereby revoking all other Wills by me heretofore made and declaring this and no other to be my last Will and Testament, In Witness Whereof I have hereunto set my hand and seal this 27th day of May 1845. Personally appeared before me, Benj. Mentzer, Register &c. in and for said county John Divelbiss, one of the subscribing witnesses to the foregoing Instrument of writing, who being duly sworn according to law did depose and say that he was personally present and saw Joshua Philips now decd. write his name unto this instrument and heard him publish pronounce and declare the same as and for his last Will and Testament, and that at the time of the doing thereof the said decd. was of sound and disposing mind, memory and understanding according to the best of his knowledge and belief, and that his name thereto subscribed as witness is in his own proper hand writing and done at the same time; also, that the signature "Jonas Divelbiss" the name of the other witness to the foregoing Instrument of writing is genuine he having seen him write his name thereunto. Mentzer, Regr. &c. in and for said county Adam McKinney who being duly sworn according to law, did depose and say that the signature "Jonas Divelbiss" the name of the other subscribing witness to the foregoing Instrument of writing is genuine according to the best of his knowledge and belief, he being acquainted with his signature having seen him write his name.
