Probated Sep. 12, 1890: I, Joshua M. Philips, of Montgomery Township Franklin County, Penna, being of sound mind, memory and understanding do make and publish this my last will and testament, hereby revoking and making void all former wills by me at any time heretofore made. And First, I direct that all my just debts and funeral expenses be paid by my Executors hereinafter named as soon after my decease as may by them be found to be convenient. Item. I give bequeath and devise to my wife Mary M. Philips (after the payment of debts and funeral expenses as above directed) for and during her natural life, all my property, Real, personal and mixed of what nature or kind soever, and wheresoever the same shall be at the time of my death. Item. After the death of my said wife Mary M. Philips I direct that all my property of whatever kind shall be sold to the best advantage either at public or private sale by my Executors hereinafter named, and that the proceeds thereof shall be divided among my children John E. Philips, Amanda L. (now intermarried with Robert A. McCune), Joseph A. Philips, Edward H. Philips, Daniel C. Philips and Mary S.J. Philips or the heirs of their body, equally, or share and share alike. Item. For the purpose of selling and conveying any or all of my Real Estate, if found necessary. I hereby confer full power and authority so to do, to my Executors herein after named. And lastly, I hereby constitute and appoint my sons Joseph A. Philips and Edward H. Philips to be the Executors of this my last will and testament, and request that no Bond be required of them. In witness whereof I Joshua M. Philips the testator have to this my last will and testament set my hand and seal this 12 day of August A.D. 1890. Joshua M. Philips as and for his last will and Testament in the presence of us, who have hereunto subscribed our names at his request as witnesses thereto in the presence of the said Testator and of each other. D.O. Cushwa M.J. Slick Pennsylvania, Franklin County S.S.: Before me, A.B. Stoler Jr., Dept. Register for the Probate of Wills & in and for said County personally came D.O. Cushwa and M.J. Slick the subscribing witnesses to the within instrument of writing, who being duly qualified according to law did depose and say that they were personally present and saw Joshua M. Philips late of the Twp. Of Montgomery in said County deceased, the testator therein named sign his name to said writing and seal the same and heard him publish and declare the said instrument as and for his last will and testament, and at the time of so doing he was of sound and disposing mind, memory, and understanding, to the best of their knowledge and belief, and that their own names thereto subscribed as witnesses were so subscribed at the request of the testator in his presence and in the presence of each other. Franklin County, S.S. Before me A.B. Stoler Jr. Dept. Register of Wills &c, in and for said County personally appeared Joseph A. Philips who being duly qualified according to law doth depose and say that Joshua M. Philips late of the township of Montgomery in said County deceased died on the 8 day of September A.D. 1890 at about 12.15 A.M. of said day. Joseph A. Register County of Franklin Registeršs Office S.S.: Be it remembered that on the day of the date hereof, the last will and testament of Joshua M. Philips late of Montgomery Township deceased being the annexed within instrument was duly proved before the Register of Wills of said county, as and for the last will and testament of said deceased, which said last will and the proofs and examinations taken thereon are recorded and filed in said office In testimony whereof I have caused the said seal of office of the said Register of Wills to be hereunto affixed.
