The petition of Geo A Smith Guardian of Daniel, Henry I and Martha J Brown minor children of Israel Brown, decd, respectfully represents. That their grandfather Daniel Brown lately died intestate leaving a tract of land in Dublin Township in Fulton County aforesaid, containing sixty six acres or thereabouts, with two dwelling houses, barn &saw mill thereon erected, also a carding and fulling mill. He further represents that after settlement of personal estate of said Daniel Brown & sale of a portion of his real estate there remained a balance of debt due by said Daniel Brown of about $600 which must be paid out of the real estate above described. He further represents that Daniel Brown left surviving him no widow but following married children Mary wife of Elias Fraker, Catharine Brown, Margaret Brown, &Rebecca Brown all of age who with the wards above named children of his son Israel are heirs and legal representatives of said Daniel Brown, deceased. He further represents that the said Mary, Catharine, Margaret, and Rebecca, have entered into an agreement with one Philip E Weaver to sell and convey unto him the said tract of land, for the sum of eighteen hundred dollars for the whole provided that he can get a title for the share of the said minor children of Israel Brown, decd, that said believed to be a good sale and the price as much as the property is worth. Your petetioner further represents that he believes it would be to the interest of his said wards are concerned, by conveyance to him of their interest in said real estate for the sum of three hundred and sixty dollars, which would be their share of the purchase money subject to deduction for payment of debt due by Daniel Brown, Dec'd. He further represents that he has agreed to sell and convey the interest of his said wards to said Philip E weaver for the said sum of three hundred and sixty dollars, provided your honor approve said sale. He therefore prays your honors to make a decree confirming the sale of the interest of his said wards in the real estate aforesaid to Philip E Weaver for the sum of three hundred and sixty dollars, and to order and direct him to make a deed to said Weaver for one undivided fifth part of said real estate, being part owned by his said wards on payment of their share of purchase money, and he will ever pray.
