He married Ruhama Snider, daughter of Rudolph "Doll" Snider. He was buried in Lemley Cemetery no. 1 near mt. Morris.His last will and testament was recorded in Greene Co., PA Will Book 2, p. 119: "No. 1098 Will of David Lemley decd. The last will and Testament of David Lemley of Perry township Greene County in the state of Pennsylvania. In the name of God Amen I david [sic] Lemley considering the uncertainty of this mortal life and being of sound mind and memory blessed be Almighty God for the same I do make and publish this my last will and testament in manner and form following that is to say first I devise that my beloved wife Ruhama Lemley will take the one third of all the proceeds of my lands, estates equitable to the laws of this estate in respect to dowery the one third part of my personal property also to enjoy it in like manner. Secondly I give and devise to my eldest son George Lemley the whole of the place he now lives or resides on in the township of and state above named containing about one hundred acres also a certain parcle [sic] or tract of land joining land with Reuben Brown and Justus G. Fordyce commencing at the creek and runing [sic] a strath [sic] line up the hollow through the meadow this line to run so as to contain forty acres. Thirdly- I give and devise to my second son David Lemley and his heirs forever all that plantation which he now resides upon being on the north west side of the creek and composed of two pieces which I bought of Abraham Willey and Robert Frakes containing in all one hundred and fifty eight acres. I likewise give and devise to him the said David Lemley the one third part of the whole of the Several tracts that adjoin each other situate in in [sic] the County and State aforesaid and lying on dunkard creek and up Bacon Run the same to be divided and valued taking into consideration quality and so that the three pieces now in one may be divided into three divisions of equal value after striking off forty acres for my eldest son George Lemley the line to run as above described. Fourthly- I give and devise to my two sons that now live on my home place Jeremiah Lemley and Asberry Lemley the whole part of my home place of about one hundred and fifty eight acres and likewise I give them the said Jeremiah Lemley and Asberry two other tracts lying and adjoining the said home place one of one hundred and sixty six acres lying along the state line in Virginia the other of one hundred and twenty five on the east of the home place all of which I give to them to be divided as near equal as possible in Value. I likewise give and bequeath unto my two sons Jeremiah and Asbery the two thirds of three several tracts of land which I bought of Postlewait Gapin and Davis and lying along Dunkard Creek and up Bacon Run as spoken of in the gift which I made to my son David the three divisions to be made as near equal as possible so that the three David, Jeremiah, and Asberry may have equal value in said land after striking off forty acres for my eldest son George Lemley as the line prescribed heretofore. I give and bequeath unto Asberry Lemley dwelling where I now live and likewise the west end of my homeplace. Fifth- I give and bequeath unto my daughter Margaret Lemley the sum of three hundred and fifty dollars. Sixth- I give and bequeath unto my daughter Catharine Lemley four hundred dollars. Seventh- I give and bequeath unto my daughter Sarah Donley the sum of three hundred and fifty dollars. Eight- I give and bequeath unto my daughter Elizabeth Evans the sum of four hundred dollars-The several legacies which I have bequeathed to my daughters Margaret, Catharine, Sarah, and Elizabeth are to be paid by my three sons David, Jeremiah, and Asberry after the following manner seven hundred shall be paid on or before expiration of two years after my death and the remaining eight hundred dollars shall be paid at the close of four years from and after the day of my death to be paid to my four daughters each daughter to in proportion to her dowery to be paid to be paid by my three sons David, Jeremiah, and Asberry each one of my three sons to pay in all the sum of $500 dollars to my daughters as stated in several bequests and lastly I give and bequeath all that may remain of my personal estate after my decease to my three sons David, Jeremiah, and Asberry that they may be more enabled to pay the several legacies which I have bequeathed to my four daughters. I exempt my son George from paying any thing as I consider his lands which I have given him is not as valuable as the gifts which I have given my three other sons and again I will and devise that Asberry Lemley shall keep Mansion house which I now live in as it is his mothers request that she may live with him the remainder of her days. And finally and lastly I do hereby make and ordain my eldest son George Lemley and my son-in-law Daniel Donley Executors of this my last will and Testament hereby revoking all former wills by me made. In Witness- whereof I have hereunto set my hand and affixed my seal this eighteenth day of September in the year of our Lord one thousand eight hundred and forty three. Signed, sealed, published and delivered by the above named David Lemley to be his last will and testament in the presence of us who at his request and in his presence have subscribed our names as witnesses thereunto. Sayers Register for the probate of Wills and granting letters testamentary Patrick Donley and Isaac Davis two of the subscribing witnesses to the within Instrument of writing and upon their solemn affirmations sayeth that they were present and saw and heard the within named testator sign, seal, publish and pronounce and declare the within instrument of writing to be his last will and testament and that at the time of doing thereof he was of sound mind, memory, and understanding to the best of their knowledge, observation, and belief. Sworn and subscribed before me this 7th day of Oct. A.D. 1843. Wm. W. Sayers Regt. Registered same day & Letters Testamentary granted sd. Inventory filed Oct 26-1843. Sale list filed Dec. 8-1843." This will was also filed in Monongalia Co., WV on 31 July 1900, possibly in anticipation of clearing the estate of his son David, who was either dead or dying at the time.
