The Petition of Stephen Albaugh was read setting forth that he is one of the sons and heirs of Stephen Albaugh late of Allegheny township, deceased, that Ezra Hart is the administrator of the estate of said deceased having taken out letters of administration on the 17th day of August A.D. 1840, and that he has filed no account nor made any settlement of his administration account, and praying the Court to award a citation to said Ezra Hart to file an account of his administration. Whereupon 18th April 1842, the Court awarded a citation accordingly. (issued) Orphan's Court Book E page 388, # 242 August Term 1842 No. 242. Proof being made of the due service of the Citation of this Court awarded at April term last, to Ezra Hart, Administrator of the estate of Stephen Albaugh, late of Allegheny township decd., commanding him to appear at the present term to settle and pass an account of his administration of said deceased, and he not appearing, and it appearing to the Court that the said Administrator has not as yet filed his said account in the Register's Office, 18th August 1842 on motion of T.P. Campbell Esq. the Court directed an attachment to be issued against said Administrator for his contempt in refusing to obey the Citation of the said Court, returnable first day of next term. (issd.) Orphan's Court Book F page 59, # 14 August Term 1843 No. 14 The Report of John Reed, auditor to whom was referred the administration account of Ezra Hart, admr. of Stephen Albaugh, decd and the exceptions thereto filed with directions to report the facts etc. was read. Whereupon 26th August A. D. 1843 after argument the Court did order and direct that the accountant be charged with the amount of the notes due by him up to the time he filed his account with the interest, that he be credited with the amount of the vouchers he has exhibited to the auditor $47.25, making the balance against him $120.61 1/2, and that the said account be confirmed absolutely. And on motion of Mr. Gwin the Court granted a rule on the said administrator to show cause on the first day of next term why he should not be discharged from his trust. Orphan's Court Book F page 78, # 234 November Term 1843 No. 234 Proof having been made of the due service of the rule of this court granted at August term last on Ezra Hart, administrator of Stephen Albough decd. to appear in court at the present term to show cause if any he had why he ought not be discharged, and the said Ezra Hart not appearing to show cause and no cause being shown, Whereupon 24th November A.D. 1843 the Court discharged the said Ezra Hart from his said administratorship of the estate of the said Stephen Albaugh decd.
