D. 1820 was read setting forth that the said David Murretts who died intestate as aforesaid seized in his demise as a fee of and in a certain plantation tract and parcel of land situate in Henderson township in the said County of Huntingdon adjoining and bounded by the waters of Stone Creek on the north east, lands of Patrick Gwin Esquire, lands in the name of James McMurtie, Esquire of Philadelphia, land in the name of James Whitehead, containing about four hundred acres more or less, of which about eighty acres are cleared with two log dwellings houses, a log barn, log stable and other improvements thereon erected. That the said deceased left a widow named Elizabeth who is since dead and issue eight children to wit Elizabeth the eldest who resides in said county and was intermarried with Christopher Myer now deceased, Jacob the eldest son who left this county unmarried about fifty years ago and has not been heard of for about twenty five years supposed to be dead, Susannah, intermarried with George Clapper of Piney Creek in said county, the said Maria Heffner, Mary intermarried with John Black who moved West, to what place is not known, said to be Indiana County or State, Michael who is since deceased, leaving a widow named Elizabeth and issue six children, Molly, John, Jacob, David, George and Mary, of whom Jacob, David, George and Mary are minors, under the age of twenty one years and have no guardians, George Murretts and Catherine intermarried with Samuel Cartwright of Sarah Furnace Bedford County. That no partition or valuation of the said Estate having been made the Petitioners are desirous of having the share of and in right of the said Maria Heiffner formerly Murretts in the said Estate ascertained by an inquest to be awarded by the said Court. And praying the Court to award an inquest to make partition or valuation of the premises aforesaid agreeably to the intestate laws of this Commonwealth. Whereupon 21st February 1838 it is considered by the Court and ordered, that an Inquest be awarded agreeably to the prayer of the petitioner, and motion of A. P. Wilson Esquire the Court appoint John McCahan to be guardian pro hac vice of the afore named minors to receive notice on this and all subsequent proceedings in this Court in relation to said Estate; and ordered that notice of the time of making such valuation be published in one newspaper in this County once a week for four successive weeks next before the time of making such valuation that notice be given to all interested residing in the county personally or by writing left at their place of abode at least ten days prior to the time of making said valuation and that return of the proceedings herein be made to the next general Orphans Court.
