All rights reserved. http://www.usgwarchives.net/copyright.htm http://www.usgwarchives.net/pa/pafiles.htm __________________________________________________________ see Deed content Written: July 14, 1802 Recorded: July 24, 1802 (Book H-1 pages 533 - 535) Deed John Brumbaugh to Henry Hoover This indenture made this fourteenth day of July in the year of our Lord, One thousand eight hundred and two, Between John Brumbaugh of the Town of Williamsburg Huntingdon County and Commonwealth of Pennsylvania Yeoman, and Mary his Wife of the one part and Henry Hoover of Lancaster County and Commonwealth afore said Yeoman of the other Part, witnesseth that the said John Brumbaugh, for and in consideration of the Rents, Covenant and Agreements herein after mentioned and _eserved on the Part and Behalf of the said Henry Hoover his heirs, Executors, Administrators the Assigns to be paid _one and performed and for the further Consideration of the Sum of One hundred and thirty five Pounds to him in hand well and truly paid by the said Henry Hoover the Receipt whereof is hereby acknowledged he the said John Brumbaugh, and Mary Brumbaugh, Hath granted released and confirmed, and by there presents doth grant release and confirm unto him the said Henry Hoover his heirs Executors, Administrators or Assigns All that _____ in the town of Williamsburg, on the River Juniata together with the Buildings and Improvments thereunto belonging, lying & being on front Street being fifty feet in front and one hundred and seventy feet back to an alley or laid out on the Ground and Marked No. 62 in the plan of said Town recorded in the Office for said County of Huntingdon in Book E page 299 or by reference being had may more fully appear, said Lot being part of a Tract of Land which was Conveyed by Patent from the Proprietaries of Pennsylvania to a certain John Swift Esqr. Who by Indenture bearing sale the 13th day of December A. D. 1795. Conveyed and Confirmed said Tact of Land to Jacob A____ ____ Jacob the conveyed the above mentioned Lot of Ground by Deed bearing take the 25th day of October in the year of our Lord 1797. tp Tobias Shaver who by his indenture dated the 16th day of June A.D. 1801 Conveyed and Confirmed the same unto John Brumbaugh Party to these Presents, To Have and to Hold the said Lot of Ground and all and singular the Appurtenances hereby granted, mentioned or intended so to be unto the said Henry Hoover his Heirs and Assigns to and for the only proper use and eh __f the said Henry Hoover his Heirs and Assigns for ever Y--- ing and paying therefore and thereout unto the said Jacob A___ his Heirs, Executors, Administrators or Assigns on the first day of November in every year the annual rent or sum of One Spanish Milled dollars or the value thereof in Lawful Money of Pennsylvania the first payment to be made on the first day of November 1802. and so on yearly and every year forever hereafter Provided always agreeably to the Articles of Agreement, entered into by the Parties thereof that if the said annual Rent of one Spanish Milled Dollar or the value thereof shall be behind or unpaid in part or in the whole by the Space of Five Days next after any of the days of payment on which the same ought to have been paid, that then it shall and may be lawful for the said Jacob A___ his heirs, Executors or Assigns, his or their Agent or Attorney to recover the rents unpaid as aforesaid by Distress of the Goods and Chattles and in case they be not found sufficient, then of the said Lot of him the said Henry Hoover his heirs or Assigns, rendering the surplus after costs being first paid, of the rent unpaid and behind as aforesaid unto the said _______ his Heirs or Assigns.
