All rights reserved. http://www.usgwarchives.net/copyright.htm http://www.usgwarchives.net/pa/pafiles.htm __________________________________________ New Frankstown, Frankstown Twp Written: May 14, 1835 Huntingdon County Deed Book Y-1 page 364 Deed Michael Hileman & wife to John Kays This Indenture made the fourth day of May AD eighteen hundred and thirty three by and between Michael Hileman of Frankstown Township in the county of Huntingdon and state of Pennsylvania and Margaret his wife of the one part and John Kays of said township county and state of the other part - Witnesseth, that whereas the said Michael Hileman and by virtue of diverse conveyances and assurances in and according to the law has become and is lawfully seized in his demesne of the fee simple of in and to a certain tract of land situate in the said township of Frankstown in said County of Huntingdon commonly known by the name of "stone house tract" and adjoining to the western end of town of new Frankstown in said township, and whereas there has been lately laid out on the said tract of land certain lots as an extension of the said town of New Frankstown at & adjoining to the western end thereof and also certain out lots adjoining to the western end of said town of New Frankstown, a plan and draft of which said lots and out lots so as aforesaid is recorded in the office for recording of deeds in and for said county of Huntingdon in Book H Page 1. Now this indenture witnesseth that the said Michael Hileman and Margaret his wife for and in consideration of the sum of one hundred dollars to them in hand paid by the said John Kays the receipt whereof is hereby acknowledged have granted bargained and sold aliened released and confirmed and by these presents do grant bargain and sell alien release and confirm unto the said John Kays and his heirs and assigns the lot marked and numbered five in the plan and draft of the said extension of the town of New Frankstown the length, breadth, situation and boundary of said lot hereby granted and conveyed being particularly mentioned and given in said plan and draft thereof recorded as aforesaid; together with all and singular the rights, ways, waters, streets, roads, alleys, lanes, privileges hereditaments and appurtenances there unto belonging or in anywise appertaining and the reversions and the remainders, rents, issues and profits thereof. To have and to hold the said lot marked and numbered five in the said plan and draft of the said extension of the town of New Frankstown hereditaments and premises hereby granted and conveyed or intended so to be with the appurtenances unto the said John Kays and his heirs and assigns to his and their proper use only and benefit forever. In testimony whereof the said parties have hereunto set their hands & seals the day and year first above written. Before me the subscriber one of the Justices of the Peace in and for the said County of Huntingdon personally appeared Michael Hileman and Margaret his wife the grantors of the above and foregoing Deed of Indenture and acknowledged the same to be their act and deed and desired that the same might be recorded as such; she the said Margaret being of full age and by me having been first examined separate and apart from her said husband and the contents thereof first fully made known unto her upon such said separate examination did declare and say that she did voluntarily and of her free will & accord sign & seal and as her act and deed did deliver the same without any coercion or compulsion whatever on the part of the husband.
