All rights reserved. http://www.usgwarchives.net/copyright.htm http://www.usgwarchives.net/pa/pafiles.htm __________________________________________ Huntingdon County, PA Deed Book E-2 p 240 James Lee to John Lee This Indenture made the seventeenth day of May in the year of our Lord one thousand eight hundred and forty four between James Lee of Hopewell township in the County of Huntingdon and State of Pennsylvania, of the one part, and John Lee of the township, county and State aforesaid, of the other part witnesseth that the said James Lee for and in consideration of the sum of twelve hundred dollars to him in hands paid by the said John Lee at and before the ensealing and delivering hereof, the receipt whereof he doth hereby acknowledge, thereof acquit and forever discharge the said John Lee, his heirs, executed and administrators by these presents have granted, bargained, sold, aliened, enfeoffed, released and confirmed, and by these presents do grant, bargain, sell, alien, enfeoff, release and confirm unto the said John Lee and to his heirs and assigns, all that certain messuage or tenement and tract of land situated in Hopewell township, Huntingdon county and State aforesaid bounded as follows, viz: beginning at a post corner on line of Ludwick Hoover thence by the lands of said Ludwick Hoover North thirty five degrees East ninety eight perches to a locust stump; thence by lands of John S. Patton surveyed in name of John Miner North fifty one degrees and a half west one hundred & fifty perches to a dead pine: thence by lands of said John S. Patton and land of Samuel Harris South thirty five degrees West ninety eight perches to a post by a marked pine, and thence by land of the said John Lee (party hereto) South fifty one degrees and a half East one hundred and fifty perchers to the place of beginning, containing eighty six acres, one hundred and seven perches with the allowance of six per cent for roads etc. Being the one fourth part of a survey in the name of James Dalton which Richard Neave the elder and Richard Neave the younger by deed dated the 29th day of August A.D. 1793 did grant & confirm unto John Wilson of Tyrone township in the County of Huntingdon aforesaid, as by Book O. page 402 in the Recorder's Office in and for the County of Huntingdon will more fully and at large appear. And Robert Wilson and Jane Wilson administrators of all and singular the goods & chattels, rights & credits which were the above named John Wilson deceased, in pursuance of an order and decree of the Orphan's Court for the County of Huntingdon aforesaid by their deeds dated the 12th day of May A.D. 1795, recorded in Book O page ??? in the Office for the recording of deeds in & for the county of Huntingdon for the consideration therin mentioned did grant and confirm unto Robert Lee then of the county of Franklin (late of the County of Huntingdon and now deceased) all the aforesaid tract or survey in the name of James Dalton then said to contain 331 as 96 ps & allowance, with the hereditaments and appertenances to him the said Robert Lee his heirs and assigns forever. And the said Robert Lee deceased by his last will & testament dated the thirteenth day of June A.D. 1803 duly proved and recorded in the Register's Office for the County of Huntingdon, did devise & bequeath unto his eldest son James Lee (party hereto) the one half part of the above mentioned survey or tract of land in the name of James Dalton being the North westerly [I think] end of the same to his heirs and assigns. Now this Indenture witnesseth that the said James Lee as for the consideration hereinbefore mentioned as for the privilege to him granted by his son the aforesaid John Lee to live and remain in the house where he the said James Lee now lived, being on the most westerly corner & fractional part of the said James Dalton survey, and within the part bequeathed to him the said James Lee as aforesaid, to occupy the premises now in his possession during his natural life, according to an agreement between them the said parties in writing, hath granted and hereby doth confirma dn convey unto him the said John Lee all the herein before described fractional and most northerly fourth part of the foregoing survey in the name of James Dalton. Together with all and singular other the houses, out houses, buildings, ways, woods, waters, water courses, rights, liberties, privileges, hereditaments and premises whatsoever thereunto belongin or in anywise appertaining, and the reversions and remainders, rents, issues and profits thereof. And also all the estate, right, title, interest, property, claim and demand whatsowever of him, the said James Lee in law or equity, or otherwise howsoever of, in, to or out of the same. To have and to hold the said messuage or tenement and tract of eighty six acres, one hundred and seven perches of land, with the allowance, hereditaments and premises hereby granted or mentioned or intended so to be with the appertenances unto the said John Lee his heirs and assigns, to the only proper use & behoof of the said John Lee his heirs and assigns forever. And the said James Lee for himself, his heirs, executors and administrators doth covenant, promise, grant and agree to and with the said John Lee, his heirs and assigns, by these presents, that he the said James Lee and his heirs the said above mentioned & described messuage or tenement and tract or piece of lands hereditaments and premises hereby granted or mentioned or intended so to be with the appertenances unto the said John Lee, his heirs and assigns, against him the said James Lee, and his heirs, and against all and every other person and persons whomsoever lawfully claiming or to claim the same or any part or parcel thereof shall and will warrant and forever defend by these presents. In witness whereof the said parties to these presents have hereunto set their hands and seals, the day and year first above written. Be it remembered that on the seventeenth day of May Anno Domini 1844, before me Isaac Vandervander Esquire, one of the Justices of the Peace in and for said county, came the above named James Lee and acknowledged the above written indenture to be his act and deed, and desired that the same might be recorded as such according to law.
