All rights reserved. http://www.usgwarchives.net/copyright.htm http://www.usgwarchives.net/pa/pafiles.htmindex.htm __________________________________________________________ This indenture made this day the Twelfth of May in the year of our Lord One thousand and eight hundred sixty, between David Rupert, Administrator of all singular the goods and chattels, rights and credits which were of Joseph Dorland late of the township of Henderson, former, deceased, at the time of his death (who died in testate) of the one part, and Samuel Rupert of the same township yeoman of the other part: Whereas the said Joseph Dorland in his lifetime, and at the time of his death was seized in his demeans as of fee and in a certain tract of land situate in the Township of Henderson in the County of Huntingdon and State of Pennsylvania, containing two hundred and seventy acres more or less, adjoining land of John Rhodes on the north, lands of Aaron Kelly on the east, lands of James Simpson and John Henner to the south and lands of Adam Rupert on the west, having a log house and a log barn thereon erected. And whereas, administration of all and singular the goods and chattels, rights and credits which were of the said Joseph Dorland at the time of his death, after the death of the said Joseph Dorland was in due form of the law committed to the said David Rupert. And whereas the said petition of the said David Rupert to the individuals of the Orphans Court of the said County, setting forth that personal estate of the said Joseph Dorland was not sufficient to pay his just debts, or a schedule of which, together with an inventory of said debts, and also a statement of all the real estate of the said Joseph Dorland was there to attached and praying the Court afore said to allow him to make sale of the said lands for the purpose a fore said, and then how it was considered and ordered by the said Court that the above described tract of land , farm, plantation, be sold according to the prayer of the said petitioner as by the records and proceedings of the said Court, reference thereunto being had may more fully and at large appear. And whereas in pursuance of said order, and by force and virtue of the laws of this State in such case made and provided, afterwards, to wit: on the second day of October in the year of our Lord one thousand eight hundred and fifty eight, the said David Rupert did, on the premises, expose to sale at public venue the above mentioned and described tract of land, farm, plantation, after duly advertising the same according to law and then and there did sell the same to the said Samuel Rupert for the sum of one thousand dollars, he being the highest and best price bidder for the same, which sale on report thereof being made to the said Judges on the twentieth day of November in the year of our Lord one thousand eight hundred and fifty eight was confirmed but he said Court and it was considered and adjudged by the said Court that the same should be and remain firm and stable forever as by the records and proceedings of the same Court reference being thereunto had more fully and at large appears. Now this Indenture Witnesseth that the said David Rupert for and in the consideration of the sum of one thousand dollars to him in hand paid by the said Samuel Rupert at and before the said sealing and delivery hereof, the receipt whereof he doth hereby acknowledge, therefore acquit and forever discharge the said Samuel Rupert his heirs, executors, and administrators by the presents hath granted, bargained, sold, released, and confirmed, and by these presents doth grants, bargain, sell, alien, enfcoff, release and confirm unto the aid Samuel Rupert all the above mentioned and described tract of land, farm or plantation. Together with all and singular the houses, out houses, buildings etc. and also all the estate, right, title, and interest whatsoever of the said Joseph Dorland in his lifetime at and immediately before the time of his death, or the said David Rupert in law or equity or otherwise howsoever, of, in, to or out of the same. To have and to hold the said piece or parcel of land, hereditaments and premises hereby granted or mentioned or intended so to be with appurtenances unto the said Samuel Rupert, his heirs, and assigns forever. Pennsylvania Huntingdon County SS; Be it remembered that on the 12th of May n the year of our Lord 1860 before me, Recorder of Deeds, in and for the said County, personally came the above named David Rupert, and acknowledged the above Indenture to be his act and deed and desired that the same might be recorded at such In Testimony.
