I Abraham Brubaker of Allegheny township Huntingdon county. Pennsylvania being weak in body but of sound mind (for which I thank the Almighty) in view of the uncertainty of life, do make and declare this to be my last Will and Testament. I first order that all my just debts be paid as soon as convenient after my death. I give and bequeath to Lydia Brubaker and her children ninety acres of land including the improvements where I now reside. I further order that the remainder of the land consisting of one hundred acres more or less be sold and the proceeds of said sale I give and bequeath to my sister Martha Brubaker, now residing in Adams County Ohio. The remainder and residue of my estate real and personal I give and bequeath to Lydia Brubaker the wife of Ephraim Brubaker. I hereby make to appoint Jacob Stiffler of Allegheny township Esecutor of this my Last Will and Testament. Witness my hand and seal this twenty fourth day of April A. D. 1845 his Witness Present. J. Landis Jacob X Brubaker mark RENUNCIATION OF JACOB BRUBAKER Know all men by these presence that I Jacob Brubaker a brother Abraham Brubaker, late of Allegheny township in the county of Huntingdon decd. hereby renounce my right to the Administration of the estate of said decd. and request the Register of said county to grant letters of administration of the said estate to Jacob Stiffler of the said township. Memorandum Letters of Administration in common form were this day granted to Jaob A Stiffler on the estate of Abraham Brubaker late of Allegheny township deceased. Inventory to be exhibited with thirty days and a just and true account of his said administration within one year or when thereunto lawfully required. Given under seal of office the 15th day of May A. D. 1845. John Reed Register [AFFADAVIT OF DR. J. A. LANDIS] Huntingdon County Pa. Before me the Register for the probate of Wills and granting letters of Administration in and for the said County personally appeared Doctor J. A. Landis who being sworn according to law doth depose and say that on the twenty- fourth day of April last he was in the room with Abraham Brubaker in the above annesced instrument named, that he the said Abraham Brubaker then requested him, this deponent to write his the said Abraham Brubaker will. That he, this deponent, then and there wrote the above anno_ed instrument of writing, agreeably to the instructions of the above said Abraham and after finished the said writing (which was dictated by the said Abraham and read to him paragraph by paragraph, while it was being written he this deponent read the whole of the said instrument in the presence and hearing of him the said Abraham Brubaker, who said it was all right, or as he wished it to be. That the said Abraham then signed the said instrument by setting his mark thereto in the presence of this deponent and in the presence of Jacob Brubaker. That the said Abraham then, in their presence, declared the said instrument to be his last Will and Testament, and requested this deponent and the said Jacob to witness the same as such. That this deponent then in the presence of the said Abraham and Jacob subscribed his name thereto as a witness and that the and said Abraham by making his mark in the name "Jacob Brubaker" subscribed to the said instrument by this deponent, and that the said Abraham was, at the time of such declaring and signing, of sound and disposing mind memory and understanding to the best of his (deponents) knowledge & belief. Sworn and Subscribed the 17th day of June A. D. 1845 J. A. Landis Before John Reed Register Huntingdon County Pa. [AFFADAVIT OF JACOB BRUBAKER] Huntingdon County ss Before me the Register for the probate of Wills and granting letters of Administration in and for the said county personally appeared Jacob Brubaker who being duly sworn according to law saith, that he was personally present and did see Abraham Brubaker in the above annexed instrument of writing names, sign the said instrument of writing by setting his mark thereto that he also heard the said Abraham pronounce and declare the said instrument to be his last Will and Testament and request him, this deponent and Doctor J. A. Landis to witness the same as such; that Doctor Landis then wrote upon said instrument what deponent believes was his, the Doctors name and also the name of this deponent; that he, the deponent, then made his mark as a witness on the left hand side of the said instrument, in what he took to be his own name, the said Doctor pointing out the peace that the said signing, or witnessing was done in the presence of the said Abraham and in the presence of the said Doctor Landis and this deponent respectively; and that he this deponent verily believes that the said Abraham Brubaker was at the time of declaring and signing as aforesaid, of sound disposing mind memory and understanding. That about a month previous to the time of making said Will, this deponent heard the said Abraham say that he intended to leave one part of his property to his sister Martha for having so well taken care of their mother, and that he intended to leave the other part of it to ____ who was then taking care of him; and that he the said Abraham was at that time living with and in the family of Ephraim Brubaker names in the above annexed instrument of writing, and that the family of the said Ephraim were then taking care of him; that the said Abraham removed into the family of the said Ephraim last fall and has continued with said family, and they (the wife and children of the said Ephraim to take care of him until the time of his death. his Sworn & Subscribed the 18th day of June Jacob X Brubaker AD. 1845 Before John Reed Register mark Note: the foregoing probate was held over and not deceased upon until 28th June 1845, when the said probate was judged to be sufficient, and the will considered as _______.
