We encourage links to the state and county table of contents. _______________________________________________________________________ Will Book 3, Pages 23-26 Huntingdon County, PA Last Will and Testament of James Crawford In the name of God, amen, I, James Crawford Sr. Of Tyrone Township, Huntingdon County and Commonwealth of Pennsylvania - [yeoman] Being in good health of Body and of Sound and disposing mind and memory and knowing the uncertainty of this mortal life and that it is appointed for all living once to die. And in order to promise peace and unanimity amongst those concerned. And for the more easy and ready settling and disposing of that portions of the good things of this life which it hath pleased the Lord to bestow upon me in this world. Imprissies [?], I do truly resign my immortal and never dying soul unto him from whom I received it who is God of Gods and Lord of Lords. An my Mortal body to the Earth from whence it came to be interred in a Christian-like manner [at the Discretion of my Executors hereafter named in full belief that it shall rise again at that great aug general Day when all shall come forth that God may Judge them. Now 1st, I order that all my just and lawful debts be first punctually paid with the costs and expenses accruing from my funeral out of my personal Estate. 2nd, I give and bequeath unto my Beloved wife, Elenor Crawford, the one third of all the annual profits arising from the place that I now live upon to be paid to her annually by my two sons, James Crawford & Armstrong Crawford in proportion of the profits of that part that each of my said sons holds agreeably to this my said will during her natural life and I bequest also to my said wife all the household furniture, bedding, and bedclothes, except two beds and all bedclothes and one of the horse creatures and two of the milk cows whichever she chooses of the horses and cows and for my said wife to have a right to dispose of all and every part of the foregoing property either before or by will at her decease and further I allow her the full right to the back five rooms on the first floor and also one of the five rooms up stairs which she chooses and privilege of cooking and washing in the kitchen during her natural life in the house. I now live in it being the same left to my son James Crawford - I give and bequest to my dutiful son, James Crawford, one hundred and fifty acres of land of the Plantation whereon I now live on together with the Dwelling house, Barn, and all other Buildings at this time on the same and usual allowance of six free ____ to him and his heirs forever Subject never ______ to the foregoing privileges and annual payment during my said wife, Elenor Crawford natural lifetime. I give and bequeath to my dutiful son, Armstrong Crawford the residence of my said Plantation whereon I know live after the foregoing part is taken off for my son, James Crawford to him my son Armstrong Crawford, and to his heirs forever and in case my said two sons cannot agree about running the Division line between them I call and order them for to choose five proper persons for to run said line with doing as little injury to each of them as will admit of Armstrong's part still subject to the annual payments to my said wife as before expected. I also bequeath to my said son, Armstrong Crawford one of my horse creatures which he chooses [after his mother makes her choice] and four of the cows and two beds and bedclothes. I then order and allow my Executors herein after named as soon as they conveniently can after my Decease to dispose of that tract of land whereon my son James Crawford now lives, and also the one John Ramsey now lives on for to make sale of the said and I empower my said Executors to make a deed or deeds of conveyance for said land and to be a legal in law or equity as if I was personally present to do the same and the money arising from the said sale I leave and bequeath in the following manner. I give and bequeath to each and every one of my beautiful daughters hereafter named viz to my daughter Mary Cadwallader, Margaret Adams, Elenor Wallace, Anna Meaner, and Nancy Graham the sum of one thousand dollars to each of them and to their heirs. Providing sale of said land together with the sale of the personal property not otherwise disposed of by this will and all my outstanding debts will pay all my lawful debts and the Bequestor hereafter mentioned their and in that case is said sales will affords my said Daughters, the full sum of one thousand dollars, I allow my Executors to pay them the said amount and for them in proportions equally to each according as the money comes to the hands of the said Executors and in case said sales fall short of paying my said Daughter the aforesaid sum of one thousand to each them they are each to receive equally of the said amount of the sale and debts to be collected and if the sale of the aforesaid property and debts after paying the said Seqaters should leave a Balance in the hands of the said Executors there I give and Bequest all of the said Balance or Remainder to be paid to my son, Armstrong Crawford. I give and bequeath to my son-in-law, James McNeal the sum of ten Dollars to be paid to him by my said Executors one year after my Decease. I give and Bequeath to each of my grandchildren by my daughter, Elizabeth McNeal (viz) To Thomas McNeal, Nancy McNeal, Eleoner McNeal, Ann McNeal and Marshall McNeal to each and everyone of my said Grandchildren the full sum of thirty dollars to be paid by my said Executors to the Guardian of said children two years after my decease said guardians to be lawfully chosen by the orphans Court of the County where the children lives, and the said sum of thirty dollars to be paid to interest by said guardians until said children attain the males the age of twenty one years and the females the age of eighteen years and if any of the said children should depart this life before they attain to the age of twenty one or eighteen years of age according to their sexes then their shares are to be divided equally amongst the others of them that are living and the interest of each of the aforesaid sums to be paid to each of said children as the come of age together with the principal. I do hereby authorize and empower and constitute my trusty friends, James Crawford and Mark Graham to be my sole Executors of this my Last Will and Testament. And I do hereby utterly disallow, revoke, disanull all and every other wise former will or testament wills legallies, bequest and executors by me or in any ways before named, willed and bequested, ratifying and confirming this and no __ to be my last will and testament. In witness whereof I have hereunto set my hand and seal this eighth day of December in the year of our Lord, one thousand eight hundred and nineteen. Signed sealed and pronounced and declared by the said James Crawford Sr. in presence of us, Sam Kyle, Samuel Rufsell, Robert Morrow. James Crawford (in German) Seal Huntingdon County, P Before said the subscriber Register for the Probate of Wills and granting letters of Administration in an for the County of Huntingdon the aforesaid personally appears Samuel Kyle and Robert Morrow two of the subscribing witnesses to the foregoing instrument of writing who upon their solemn oaths say that they were personally present and did see and hear James Crawford the Testator sign, seal, publish, and declare the foregoing instrument of writing as and for his Last Will and Testament and that the said Samuel Kyle and Robert Morrow did subscribe their respective names thereto as witnesses in the present of the Testator and by his instance and request and in the presence of each other and also in the presence of Samuel Rufsell the other subscribing witness whose these deponents did likewise see subscribe his name thereto as a witness in the presence of the Testators and at his instance and request and that the said Testator James Crawford was at that time of sound and disposing mind and memory to the best of their Judgment and Belief. Sworn and Subscriber This 9th September 1822 Before me Dick de Smith Register Samuel Kyle Robt Morrow James Crawford and Mark Graham Executors Of James Crawford Sr. Dec Memorandum Letters Testamentary were this day granted to James Crawford and mark Graham of the Estate of James Crawford Sr. decease. Inventory to be exhibited on or before the ninth day of October next and a true and just account calculations and reckoning of their said Administrations on or before the ninth day of September in the year of our Lord One thousand eight hundred and twenty three or when thereunto legally required.
