We encourage links to the state and county table of contents. ____________________________________________________________ Writ of partition of the estate of Ludwig Fisher, Sr. Even though this writ of partition is from Fulton Co, PA it is included here in the Huntingdon County Archives because a large number of of Ludwig's descendents lived in Todd and Lincoln Townships, Huntingdon Co, PA, specifically Newberg and Entriken. Background Information: LUDWIG (LUDWICK) FISHER, SR. was born 17 Mar 1777 in Frederick Co, MD and died 11 Mar 1856 in Licking Creek Twp, Fulton Co, PA. He had one known brother, John. He was married in Frederick Co, MD, on 26 Apr 1796 to Elizabeth Crawford who was born 15 May 1778 in Frederick Co, MD and died 08 Nov 1857 in Fulton Co, PA. After his death his widow and some of the children remained on the property. On 7 Jan 1857 his son, Benjamin, petitioned the Orphan's Court of Fulton Co. for a Writ of Partition since Ludwig died intestate. Fisher, Ludwick's Estate) To the Honorable the Judges of the Orphan's Petition for Partition ) Court of Fulton County of Jan 7, 1857. The petition of Benjamin Fisher of the County of Fulton respectfully represents: That your petitioner's father Ludwick Fisher late of Licking Creek Township in said county died intes-tate siezed on his domesne as of fee of and in a certain tract of land and situate in said Township comprising two contiguous tracts usually regarded as one tract adjoining lands of James Dover on the East Sidling Hill on the West, Conrad Brant on the North, and Benjamin Greenland on the South, containing three hundred & eight acres - That said intestate left a widow Elizabeth Fisher and issue eleven children viz: John Fisher [John C. Fisher] residing in Huntingdon County Penna, Jacob residing in Greenup County Kentucky, Benjamin residing in Fulton County Penna, Frederick residing in Lawrence Cty Ohio, Joseph residing in Bedford County Penna, Mary intermarried with Miles Cook, residing in Fulton County Illinois, Andrew residing in Fulton County Penna, Ludwig residing in the same county, David in the same county [David eventually relocated to Bureau Co, IL] and Elizabeth intermarried with David Stevens residing in Huntingdon County Penna - and Catharine who was intermarried with Samuel Diggens and who is now dead leaving issue ten children to wit: Joseph residing in Huntingdon County Penna, John residing in the State of Indiana, Elizabeth in the State of Iowa, Lewis in the State of Indiana, Samuel residi ng in the County of Huntingdon Penna, Peter residing in the State of Illinois, David in the same state, Nancy residing in Indiana County Penna, Henry residing in Huntingdon Co Penna and Jesse in Fulton County Penna - the two last of whom are minors. Your petitioner further represents that since the death of said intestate said widow and heirs have continued to hold said land together and undivided and that they are desirous of having the same valued and appraised under the intestate laws of the Commonwealth. He therefore prays your Honors to award a writ of partition directing the Sheriff of said County to summon an inquest to make partition of said real estate to and among the said widow & children if the same could be made without prejudice to & spoiling of the whole thereof and if the same could not be parted and divided so as to accommodate the widow and all the children prejudice to and spoiling the whole then to ascertain how many of the same would accommodate an d value and appraise the same and make return of their proceedings to the next Orphan's Court according to law. And he will ever pray. Benjamin Fisher Additional records: On 6 Apr 1857, the sheriff reported back to the Court that the judges had determined that the land could not be divided without spoiling it and that the land was to be sold for $7.20-3/4 per acre and the proceeds divided among the heirs according to intestate law. On 3 Aug 1857 it was determined that the total value after expenses was $2170.05 to be divided 1/3 to the widow and 2/3 to the 11 heirs (including the deceased heir). Thus, Elizabeth Fisher received $723.35 and each living child $131.51. Each of the children of the deceased child, Catherine (Fisher) Diggins received $13.15. Upon the death of Elizabeth each living heir was to receive 1/11 of her share or $65.76 and each heir of Catherine (Fisher) Diggins was to receive $6.57. In the end, sons Benjamin and Andrew jointly purchased the land from the rest of the heirs. An inventory of his personal property taken 13 Mar 1856, filed 8 Apr 1856 is in the Fulton Co probate records. The total was approximately $3000 including notes, bonds and ready cash. Both Ludwig and his wife Elizabeth are buried in the Green Hill Presbyterian Church Graveyard, Licking Creek Twp, Fulton Co, PA (Just off Hwy 30 Northwest of McConnellsburg).
