I Joseph Jackson Lee, of Huntingdon Pennsylvania being of sound mind, but in feeble health do make and ordain this my last will and testament as follows: First I direct my executors hereinafter named to pay my just debts and funeral expenses as soon after my decease as possible. Second. I give and bequeath to my wife Julia Ann one-third of my estate after payment of my debts; my estate being all of a personal nature and it being my intention that my said wife shall have the same interest these in that she would have if I had died intestate. Third. I give and bequeath to my two daughters, Emma Jane, and Lydia the sum of one hundred dollars each to be paid to them respectively when they are married or arrive at twenty one years of age, whichever shall first happen, and I authorize my executors, at their discretion, in the meantime to apply a reasonable amount out of my estate for clothing and schooling my said daughters. Fourth; I give and bequeath to my six sons, Thomas J., John R., Charles, George, Frank and Harry the residue of my estate whatever it may be. Fifth. Having recently entered into partnership with my brother John D. Lee in keeping the Exchange Hotel, I authorize my executors to have the business carried on either for one year, or during the lease which we hold of the property; they permitting my oldest son Thomas J. with the assistance of my family to take my place in the business. Sixth. John D. Lee and myself having this day settled our accounts so as to make as equal partners in the business aforesaid, I direct that my share of the profits of the business if any shall be applied to the pay of my Share of three notes given by myself and John D. Lee to William C. McNulty in past payment for hotel furniture (, said three notes amounting in all when given to $2000) Seventh. When the said partnership business is closed, I direct my executors to apply whatever is due my estate, either from the profits of the business, or sale of the partnership property for the use of my family as before provided in this will, or if in their ??? or it would be better to do so, I authorize them to invest the money or a part thereof in the purchase of a home for the use of my wife and children. Eighth; In case my executors purchase real estate for the use of my family, I empower them to take the little in their own money in trust for the use of my wife Julia Ann while she shall remain my widow, and for the use of my children, before named during their minority or while they shall remain with their mother. Ninth. If my executors should deem it necessary or proper to sell the real estate so purchased either for the purpose of making distribution among the heirs or for any other cause, I authorize them to do so, and to execute a proper conveyance to the purchases, and the money arising from such sale to be distributed according to provisions of this will as before stated. Tenth. I appoint my brother John D. Lee and my friend and cousin Saml. I. Brown the executors of this my will. In witness whereof I have hereunto set my hand and seal to this will written on one sheet of paper this twenty sixth day of April in the year of our Lord one thousand eight hundred and sixty six. J. Womelsdorf Register for the Probate of Wills and granting Letters of Administration in and for the county of Huntingdon, personally came Saml. I. Brown and Peter Swoope Esqr. The subscribing witnesses to the above will and being duly affirmed according to the law did depose and say, that they were both present and saw and heard J. Jackson Lee the testator sign, seal, publish, pronounced and declare the foregoing instrument of writing as and for his testament and last will, and that at the time of so doing he the said testator was of perfect and sound mind, memory and understanding to the best of their knowledge, observation and belief.
