Box 765, East Main Street & Domenica Circle, Clarion, Pennsylvania 16214, Grantee, or party of the second part: witnesseth, that the said party of the first part, in consideration of One ($1.00) dollar, to them now paid by the party of the second part, does grant, bargain, sell, and convey unto the said party of the second part, its successors and assigns, all the oil, gas, coal, and all other minerals lying or being in and under ALL that certain piece, parcel, or tract of land located in Grant Township, Indiana County, Pennsylvania, bounded and decsribed as follows: BEGINNING at a post corner of the land of W.W. Prothero, thence along said land of W.W. Prothero South 2 ½ ? West 123 perches to a stone thence along other land of which this is a part North 87 ½ ? West 65.1 perches to a post corner of tract sold to John and Robert McElhoes thence along said part North 2 ½ ? East 123 perches to a post in line of Rebecca Spicher, thence along said line South 87 ½ ? East 65.1 perches to the place of beginning. CONTAINING 50 acres, strict measure, be the same more or less. TOGETHER with the rights of ingress, egress and regress into, through, over, along and across the lands above described for the purpose of examining and searching for, and of mining, manufacturing, and preparing the said coal and other minerals for market, and of boring and drilling for and carrying away said oil and gas, together with the right to lay pipelines for the purpose of carrying the same, and of mining, manufacturing and removing said coal and other minerals from the property hereof, and other coal and minerals now owned or that may hereafter be acquired by the said party of the second part, its successors and assigns, and for these purposes to build roads, railroads, and drains upon and under the surface of said property and to locate and erect such chutes, tipples, derricks, buildings, and other structures with the necessary curtilage, as may be necessary and proper for the convenient use and working of the said mines, wells, or works in connection therewith, and with the right to deposit the dirt or waste of the said mines, wells, or works upon the surface convenient thereto. BEING the same property excepted and reserved by Elias Fetterman in deed to Albert T. Ager, dated April 18, 1913, and recorded in Indiana County Deed Book Volume 137, Page 203. Elias Fetterman acquired title to the property by deed of Daniel Rairigh, et al. dated February 7, 1881, and recorded in Indiana County Deed Book Volume "A" 42, Page 542. Elias Fetterman died testate on November 28, 1919, seized of the above described tract of land. His will was admitted to probate by thr Register of Wills of Indiana County and is filed in Will Book Volume 18, Page 387. The Grantor is an heir of Elias Fetterman as is more fully set forth and described in the Affidavit of Ivan Fetterman which is recorded in Indiana County Deed Book Volume 880, Page 505. With the appurtenances: TO HAVE AND TO HOLD the same unto and for the use of the said party of the second part, its successors and assigns forever, and the said party of the first part, for their heirs, excutors, administrators, convenant with the said party of the second party, its successors and assigns, against all lawful claimants generally the same and every part thereof to warrant and defend.
