Cooper and Marie G. Cooper, his wife, of the Township of Montgomery, County of Indiana, and Commonwealth of Pennsylvania, (Grantees) witnesseth, that in consideration of one and 00/100 ($1.00) dollars, in hand paid, the receipt whereof is hereby acknowledged, the said grantor does hereby grant and convey to the said grantees, all that certain piece, parcel or lot of ground situate in the Township of Green, County of Indiana, and State of Pennsylvania, bounded and described as follows: BEGINNING at an iron peg on the eastern line of Legislative Route No. 32169, being 25 feet northwesterly from a pine tree, thence by said Legislative Route No. 32169, in a southerly direction 150 feet, more or less, to an iron peg, corner of land of Zoe Sensabaugh, of which this tract is a part; thence by last mentioned lands in an easterly direction 500 feet, more or less, to a locust tree, corner of land of Zoe Sensabaugh; thence by land of said Sensabaugh in a northerly direction 150 feet, more or less, to a stone corner, land of Mrs. Elmer McCullough, being formerly a part hereof; thence by said last mentioned land in a westerly direction 500 feet, more or less, to an iron peg, the place of beginning. Having a frame dwelling erected thereon. EXCEPTING AND RESERVING from the above-mentioned parcel a 5000 square foot tract of land conveyed to Ivan R. Meekins and Margaret J. Meekins, his wife, by deed of Roy S. McCullough and Grace McCullough, his wife, dated July 16, 1962, and recorded in the Indiana County Recorder of Deeds Office in Deed Book Volume 512, Page 134. EXCEPTING AND RESERVING, however, from the operation of this Deed, all the coal being in and under the above described tract of land, together with mining rights, release of damages, etc., as fully as the same has been heretofore excepted and reserved. BEING, the same premises, title to which became vested in Elmer McCullough and Mabel McCullough, his wife, by Certificate of Distribution of the Estate of Grace McCullough, a/k/a Grace Nerve McCullough, dated June 24, 1977, and recorded in the Indiana County Recorder of Deeds Officein Deed Book Volume 727, Page 100. The said Elmer McCullough deceased May 11, 1990, and by virtue of tenancy-by-the-entirties, title to the subject property became vested in Mabel McCullough solely. THIS DEED properly notes the conveyance of the above-described 5000 square feet to Ivan R. Meekins, ux., which was failed to be included in the description of the subject premises in the Certificate of Distribution of Real Estate of the Grace McCullough Estate. SECOND: ALL that certain piece, parcel or tract of land situate in the Township of Green, County of Indiana, and State of Pennsylvania, bounded and described as follows, to-wit: BEGINNING at East of highway Route number 32169, East 500 feet to a stone corner of Roy and Grace McCullough, thence along the line of Zoe Sensabaugh to a stone corner North 150 feet west 500 feet along the line of Zoe Sensabaugh to a stone corner, thence south 150 feet along the public highway 32169 to a pine tree or the place of beginning. EXCEPTING and RESERVING, however, from the operation of this deed, all the coal being in and under the above described tract of land, together with mining rights, release of damages, etc., as fully as the same has been heretofore excepted and reserved. BEING, the same premises, title to which became vested in Mabel McCullough and Elmer McCullough, her husband, by deed of Zoe Sensabaugh, widow, dated January 14, 1942, and recorded in the Indiana County Recorder of Deeds Office in Deed Book Volume 333, Page 22. The said Elmer McCullough deceased May 11, 1990, and by virtue of tenancy-by-the-entirties, title to the subject premises vested in Mabel McCullough, solely. THIS CONVEYANCE is exempt from any State or Local Realty Transfer Tax since it is between mother and daughter and son-in-law. NOTICE In accordance with the provisions of "The Bituminous Mine Subsidence and Land Conservation Act of 1966", I/we, the undersigned grantee/grantees, hereby certify that I/we know and understand that I/we may not be obtaining the right of protection against subsidence resulting from coal mining operations and that the purchased property may be protected from damage due to mine subsidence by a private contract with the owners of the economic interest in the coal. I/we further certify that this certification is in a color contrasting with that in the deed proper and is printed in twelve point type preceded by the word "notice" printed in twenty-four point type.
