Fetterman, widower, individually, of R.D. #1, Box 72, Glen Campbell, PA 15742, and as Administrator of the Estate of Nora A. Fetterman, deceased, late of that same address, in Montgomery Twp., Indiana County; and Wava A. Williard, widow, of R.D. #1, Box 75, Glen Campbell, PA 15742, (Grantors), and Melvin S. Fetterman, widower, individually, of R.D. #1, Box 72, Glen Campbell, PA 15742 (Grantee) witnesseth, that in consideration of one ($1.00) or more dollars, in hand paid, the receipt whereof is hereby acknowledged, the said grantors do hereby grant and convey to the said grantee, his heirs and assigns, FIRST PIECE: All that certain piece, parcel or tract of land situate in the Township of Montgomery, County of Indiana and Commonwealth of Pennsylvania, bounded and described as follows: On the north by lands now or formerly of Virgil Conner, and before that William Smith; on the east by lands now or formerly of C.A. Conner, and before that of Joseph Schmittle; on the south by public road leading from Arcadia to Wilgus; on the west by lands now or formerly of Eva P. Fetterman, and prior grantees herein. CONTIANING 1 Acre, more or less. EXCEPTING AND RESERVING, however, from this indenture, all the coal, together with the coal mining rights as heretofore excepted, reserved or conveyed by former owners. SECOND PIECE: Also all those four certain pieces, parcels or lots of ground situate in the village of Wilgus, Township of Montgomery, County of Indiana, and Commonwealth of Pennsylvania, separately bounded and described as follows: FIRST: On the north by Lot No. 4, Block No. 26: on the west by an alley and being 140 feet on Eight Street and extending back of equal width along Market Street 100 feet, and known and numbered as Lots Nos. 5 and 6 in Block 26 in the Plan or Plot of lots of the Wilgus Land Company. SECOND: On the north by Lot No. 2 in Block 25; on the east by Market Street; on the south by Eight Street; and on the west by an alley. Being 50 feet front on Market Street and extending back od equal width 140 feet to an alley, and being Lot No. 1 in Block No. 25. THIRD: On the norht by Lot No. 7 in Block No. 8; on the east by the alley; on the south by Lot No. 5, in Block No. 8 and on the west by Market Street. Being 50 feet front on Market Street and extending back of equal width 140 feet front to said alley and being Lot. No. 6 in Block No. 8. EXCEPTING AND RESERVING, however, from the operations of this indenture, the coal and mining rights as heretofore excepted, reserved or conveyed. THIRD PIECE: All that certain piece, parcel or lot of ground situate in the Township of Montgomery, County of Indiana, and Commonwealth of Pennsylvania, bounded and described as follows: On the north by Lot No. 2 in the Block No. 7 140 feet, on the east by an alley 50 feet; on the south by Eighth Street 140 feet and on the west by Market Street 50 feet. Known as Lot No. 1 in Block No. 7 in the Plan of lots laid out by the Wilgus Land Company. EXCEPTING AND RESERVING the coal, coal oil, gas, fire clay and all other minerals, also all the timber with the right to remove the same, together with the right and privileges which are reserved in deed from John W. Clark, et ux. to Wilgus Land Company and recorded in Deed Book Vol. 84, Page 348. FOURTH PIECE: All the right, title and interest if the Beech Creek Extension Railroad Company, a corporation, in and to all that portion of the right of way of the former Hooverhurst Branch of the Beech Creek Extension Railroad situate in the Township of Montgomery, County of Indiana, and Commonwealth of Pennsylvania, lying within the bounds of the premises conveyed by Pennsylvania Coal and Coke Corporation, to M.F. Fetterman, et al. by deed dated August 8, 1941and recorded in the office aforesaid in Deed Book Vol. 341, Page 395, and being all those portions of the right of way of the former Hooverhurst and Southwestern Railroad which were excepted and reserved from the premises conveyed by Pennsylvania Coal & Coke Corporation to M.F. Fetterman and John Fetterman by deed dated and recorded aforesaid. AND BEING the same four (4) pieces and all the same premises that were conveyed to the within grantors by Deed dated January 15, 1992 from Victor M. Fetterman and Linda Fetterman, his wife, which is record in the Office of the Recorder of Deeds in and for Indiana County, Pennsylvania in Deed Book 995, Page 863. NOTICE In accordance with the provisions of "The Bituminous Mine Subsidence and Land Conservation Act of 1966", I/we, the undersigned grantee/grantees, hereby certify that I/we know and understand that I/we may not be obtaining the right of protection against subsidence resulting from coal mining operations and that the purchased property may be protected from damage due to mine subsidence by a private contract with the owners of the economic interest in the coal. I/we further certify that this certification is in a color contrasting with that in the deed proper and is printed in twelve point type preceded by the word "notice" printed in twenty-four point type. Hendricks (SEAL) This 1st day of September 1992 and, the said grantors, do hereby covenant and agree to and with the said grantee, that they, the grantors their heirs, executors and administrators, shall and will warrant ------GENERALLY----- and forever defend the herein above described premises, with the hereditaments and apurtenances, unto the said grantee his heirs and assigns, against the said grantors, and against every other person lawfully claiming or who shall hereafter claim the same or any part thereof. This document may not sell, convey, transfer, include or insure the title to the coal and the right of support underneath the surface land described or referred to herein, and the owner or owners of such coal may have the complete legal right to remove all of such coal, and, in that connection, damage may result to the surface of the land and any house, building or other structure on or in such land. The inclusion of this notice does not enlarge, restrict or modify any legal rights of estates otherwise created, transferred, excepted or reserved by this instrument. (This Notice is set forth pursuant to Act No. 255, approved September 10, 1965, as amended.) It is certified to comply with the Pennsylvania Realty Transfer Tax Act that the within conveyance is exempt, as to one-half ( ½ ) because it is from a grantor to himself, and as to the other one-half ( ½ ), because it is from a sister to a brother.
