Fetterman This Deed made the 15th day of May in the year of our Lord one thousand nine hundred seventy-four between M.F. Fetterman, a/k/a Murray F. Fetterman and Nora A. Fetterman, his wife, of the Township of Montgomery, County of Indiana and Commonwealth of Pennsylvania, (Grantors) and M. F. Fetterman and Nora A. Fetterman, his wife, of the Township of Montgomery, County of Indiana and Commonwealth of Pennsylvania, (Gantees) witnesseth, that in consideration of one and no/100 -------- in hand paid, the receipt whereof is hereby acknowledged, the said grantors do hereby grant and convey to the said grantees, all that certain piece, parcel or tract of land situate in the Township of Montgomery, County of Indiana and Commonwealth of Pennsylvania, bounded and described as follows: On the north by lands of Virgil Conner, formerly William Smith; on the east by lands of C. A. Conner, formerly Joseph Schmittle; on the south by public road leading from Arcadia to Wilgus; on the west by lands of Ava P. Fetterman, and grantees herein. Containing 1 acre, more or less. EXCEPTING AND RESERVING, however , from this indenture, all the coal, together with the coal mining rights as heretofore excepted, reserved or conveyed by former owners. BEING the same premises the title to which became vested in M. F. Fetterman by deed of Eva P. Fetterman, unmarried and Ivan C. Fetterman and Gertrude Haer Fetterman, his wife, dated October 19, 1948 and recorded in the Recorder's Office of Indiana County in Deed Book Vol. 480, page 309. ALSO ALL those two certain pieces, parcels or lots of ground situate in the village of Wilgus, Township of Montgomery, County of Indiana and Commonwealth of Pennsylvania, separately bounded and described as follows: On the north by Eighth Street; on the east by Market Street; on the south by Lot No. 4, Block No. 26; on the west by an alley and being 140 feet on Eighth Street and extending back of equal width along Market Street 100 feet, and known and numbered as Lots Nos. 5 and 6 in Block 26 in the Plan or Plot of lots of the Wilgus Land Company. SECOND: On the north by Lot No. 2 in Block 25; on the east by Market Street; on the South by Eighth Street; and on the west by an alley. Being 50 feet front on Market Street and extending back of equal width 140 feet to an alley, and being Lot No. 1 in Block No. 25. THIRD: On the north by Lot No. 7 in Block No. 8; on the east by an alley; on the south by Lot No. 5, in Block No. 8 and on the west by Market Street. TITLE to the above described lot having vested in Murray F. Fetterman by deed of C.D. Gorman and Essie G. Gorman, his wife, dated September 16, 1921 and recorded in the office aforesaid in Deed Book Vol. 204, Page 49. ALL the right, title and interest of the Beech Creek Extension Railroad Company, a corporation, in and to all that portion of the right of way of the former Hooverhurst Branch of the Beech Creek Extension Railroad situate in the Township of Montgomery, County of Indiana and State of Pennsylvania Coal & Coke Corporation to M.F. Fetterman, et al. By deed dated August 8, 1941 and recorded in the office aforesaid in Deed Book Vol. 341, Page 395, and being all those portions of the right of way of the former Hooverhurst and South Western Railroad which were excepted and reserved from the premises conveyed by Pennsylvania Coal & Coke Corporation to M.F. Fetterman and John Fetterman by deed dated and recorded aforesaid. BEING the same premises the title to which became vested in Murray F. Fetterman by deed of Beech Creek Extension Railroad Company, a corporation, and the New York Central Railroad Company, a corporation, dated December 17, 1947 and recorded in Deed Book Vol. 374, Page 459. ALSO ALL the undivded one-half interest of, in and to all the following described pieces, parcels or tracts of land situate in the Township of Montgomery, County of Indiana and Commonwealth of Pennsylvania, bounded and described as follows: FIRST: BEGINNING at a chestnut corner of lands now or formerly of Lewis Deabenderfer and W.B. Smith; thence by lands now or formerly of said W.B. Smith and Oscar Brickle, north 86 ¼ ? west 166.2 perches to a post; thence by lands now of formerly of H. Schreckengost and Daniel Rairigh, south 6 ½ ? west 182.8 perches to a post; thence by land now or formerly of Alpheus Clark, south 85 ¾ ? east 162.8 perches to a post; thence by land now or formerly of Lewis Deabenderfer north 7 ½ ? east 184.1 perches to a chestnut, the place of beginning. TITLE to said premises having vested in Nora A. Fetterman, by deed of Ivan C. Fetterman and Gertrude H. Fetterman, his wife, dated September 1970 and recorded in the Recorder's Office of Indiana County in Deed Book Vol. 612, Page 598. The purpose of this conveyance being to vest title to the said premises in said grantees as tenants by the entireties with the right of survivorship. And the said grantors hereby covenant and agree that they will warrant the property hereby conveyed. This document may not sell, convey, transfer, include or insure the title to the coal and right of support underneath the surface land described or referred to herein, and the owner or owners of such coal may have the complete legal right to remove all of such coal, and, in that connection, damage may result to the surface of the land and any house, building or other structure on or in such land. The inclusion of this notice does not enlarge, restrict or modify any legal rights or estates otherwise created, transferred, excepted or reserved by this instrument.
