David S. Fulcomer, 64, a former resident of Holland Township and a longtime teacher at the Holland Township School who became embroiled in a protracted legal battle with the school board after his dismissal in 1962, died unexpectedly on Monday while on route to his home in Vacation Village, Florida. Fulcomer is also a former resident of Stewartsville, Pa. He was born in McKeesport, Pa., son of the late Curtis and Sara Harris Fulcomer. He was a graduate of Tyrone, Pa., high school and he had degrees from Susquehanna University, Duke University, a masters degree from New York University and an elementary teaching degree from Rutgers. Fulcomer taught math at the Holland Township School from 1954 to 1962 and then from 1967 to 1971 when he retired and moved to Flroida. He also taught at Philipsburg High School and at a school in Riverhaed, N.Y. He was interested in teener league baseball and served as a coach. He as a U.S. Army Veteran of W.W. I and was the first commander of the Meesey Bishop American legion Post in Stewartsville. Fulcomer is survived by his wife, Mrs. Mary Fulcomer; three sons, Robert D. and William E. both of rural Milford and Jerry E. of rural Hackenttstown; a daughter, Mrs. Natoli Gualberti of rural Milford; eight grandchild; two brother Verne K. of Tyrone, Pa. And George W. of Turtle Creek, Pa.; four sisters, Mrs. Alice Knarr, Mrs. Clara Morder and Mrs. Velma Heilman, all of Tyrone and Mrs. Irene Pitts of Warren, Ohio. Funeral services will be private. Fulcomer who began teaching at the Holland School in 1954 was dismissed in 1962 after he allegedly used physical force to discipline a 14-year-old student in one of his classes. Fulcomer was dismissed by the Holland Board after a hearing was conducted by the state’s commissioner of education. Fulcomer appealed to the State Board of Education and was granted a second hearing in 1964 but the dismissal was upheld. Fulcomer carried his case to the courts and in 1967 the Appelate Division of the Superior court after ruling that dismissal was too harsh a penalty returned the case to the new Commissioner of Education, Dr. Carl Marburger. In August of 1967, Commissioner Marburger ordered Fulcomer’s reinstatement at the Holland Township School with his tenure and pension rights restored but without back pay. Fulcomer then began a long and ultimately unsuccessful battle to try and get court permission to sue the township and state boards for damages. During his suspension from the Holland School, Fulcomer taught in Riverhead, N.Y. Throughout his fight with the township and state boards Fulcomer maintained that he was dismissed not solely because of the incident with the student but because of his ideas on discipline and education.
