Sent to me[Vernon C. Cook] by Clifford E. Rice, 6355 Crawford St., San Diego, CA 92120 in September 1996. In the name of God, Amen. I Conrad Rice of Centre Township in the County of Indiana being weak in body but of sound and disposing mind memory and understanding, Condidering the certainty of death and the uncertainty of the time thereof, and being desirous to settle my worldly affairs and thereby be better prepared to leave this world when it shall please God to call me home, do therefore make and publish this my last will and testament in manner and form following that is to say___. First and principally, I Commit my Soul unto the hands of Almighty God and my body to the earth to be decently buried at the discretion of my executors herein after named and after my debts and funeral charges are paid.  Such worldly Estate wherewith it has pleased God to bless me in this life. I give devise and bequeath as follows ____ . I give and bequeath unto Philip Rice my oldest son one hundred and thirty two acres of land whereon he now resides agreeably to the lines as is now surveyed off for him being a part of my plantation whereon I now dwell unto him the said Philip and his heirs and assigns  forever him  the said Philip yielding and paying therefor the Sum of Four Hundred and Sixty six Dollars and fifty Cents, in the manner herein after mentioned to wit: immediately after my decease it is my will that he the Said Philip pay to my daughter  Barbara twehty five Dollars, two years thereafter that he appropriate to the use of the Children of my daughter Catharine Middleton (excepting her daughter Elizabeth now Bates) the Sum of Fifty Dollars  according to the manner hereinafter mentioned. one year thereafter that he pay my  Son in law John Lydick fifty Dollars. The fourth year after my decease that he the said Philip pay my daughter Susan Adams, Fifty Dollars, the fifth year after my decease that he pay my grandaughter, Elizabeth Bates Twenty five Dollars. the Sixth year after my decease, that he pay my daughter  Barbara fifty Dollars. the Seventh year after my decease that he pay and appropriate to the use of the children of my daughter Catherine Middleton as aforementioned and intended the Sum of Fifty Dollars and the Eight year after my decease, my Son in Law John Lydick and wife Forty one Dollars, and fifty Cents. the ninth year after my decease my daughter Susan Adams, the sum of Fifty Dollars. the Tenth year after my decease my daughter Barbara, Fifty Dollars and the eleventh year after my decease my daughter Susan Adams the Sum of twenty Five Dollars_ Item:  I give devise and bequeath unto my son Conrad all the residue of the plantation whereon I now dwell Containing one hundred and thirty two acres according to the lines of the same said  now Surveyed off for him. unto him the Said Conrad his heirs and assigns forever by him paying to the same persons. the same sums of Money in the same manner and at the same times and in the same proportions that my son Philip is to pay to Making in all to my Daughter Barbara, Two hundred and fifty Dollars. my Son-in law John Lydick and wife, one hundred and eighty three Dollars. the Children of my daughter Catharine Middleton excepting Elizabeth, Two hundred Dollars, my daughter Susan Adams, two hundred and fifty Dollars and my Grand Daughter Elizabeth Bates fifty Dollars____ Item:  it is also my will that my daugher, Barbara shall have the use of the room which is (struck off--adjacent to ?) the kitchen in my (? unreadable) house for her exclusive use and occupancy  with the priviledge of the Kitchen, the Cellar and Spring house, and the upper one half of the garden So long as she may remain unmarried. I also give and bequeath unto my Said Daughter, Barbara one Cow of her own choice out of those I may possess at my decease, one feather Bed and bed clothes and all my kitchen furniture it is also my will that my Sons Philip and Conrad find and provide for Said Barbara So long as she may remain Single a Sufficient quanity of hay and fodder to keep two cows and her sheep with the priviledges of pasture for them and to keep one or two hogs, to find her in firewood ready cut at the door. to have her grain ground and milled whenever she stands in need thereof  and to Sow her one half bushel flax yearly and give her ground well manured and in good order Sufficient to plant three Bushels potatoes yearly. Item: I give and bequeath unto my Son Philip, my ( Sampson horse-with all my blacksmith tools reserving to my Son Conrad the right of doing his own work with them___ Item: I give and bequeath unto my son Conrad all the residue of my property real personal and mixed and it is my will that he pay all my just debts as soon as convenient  may be after my decease____ And Lastly I do hereby Constitute and appoint my Said Sons Philip and Conrad to be Sole executors of this, my last will and testament. revoking and annulling all former wills, by me made. ratifying and Confirming this, and none other to be my last will and testament. In testimony whereof I have hereto Set my hand and affixed my Seal this thirty first day of December in the year of our Lord one thousand eight hundred and Sixteen. Signed Sealed published and declared by the Said Conrad Rice s/ Conrad Rice  [SEAL} as and for his list will and testament in presence of us s/ James Loughry    s/ James McKnight It is also further willed (?)me and that  It shall be taken, deemed and understood as a part of my foregoing will that my  executors therein named Shall appropriate the money therein bequeathed unto the children of my Daughter Catharine Middleton (excepting Elizabeth) to the purchase and payment of land for said children and that my son in law James Middleton and wife Catharine shall have the privildge of residing thereon with said children during their lives but that Said James and Wife have no other interest in the Same than that already mentioned. I hereby revoke and disannull  all the several Sums of money bequeathed to my grandaughter Elizabeth Bates and it is my will that my Sons Philip and Conrad do keep for their own proper use and benefit the Said Sums of money bequeathed to her the Said Elizabeth. Witness my hand and seal Signed Sealed in presence of s/ James McKnight  s/ James Loughry                        s/Conrad Rice [SEAL] Be it remembered that on the twenty fourth day of June A D one thousand Eight hundred and Twenty three personally appeared before me James Speer Register for the probate of wills and Granting Letters of Administration in and for the County of Indiana, James Loughry and John Ross surviving witnesses of the above mentioned will of Conrad Rice and being duly sworn did depose and say that they were personaly present and did hear Conrad Rice the testator acknowledge the same as and for his last will and testament and at the same time they believed him to be of sound and disposing mind and memory and that the names James Loughry and John Ross and James McKnight subscribed thereto as witnesses are in their own proper handwriting and at the same time the signature of the testator Conrad Rice was had (?). 23 June 1823  ``````````````````````````````````````````````````````````````````
