Deeds, Book 7, p. 84 (FHL #0923843) This Indenture made the eighth day of August in the year One thousand eight hundred and fifty three Between Jacob Smith of Winslow Township Jefferson County State of Pennsylvania and Barbara his wife parties of the first part and John D Philippi of the township county and State aforesaid party of the second part Witnesseth that the said parties of the first part for and in consideration of the sum of Seven hundred Dollars the receipt whereof is hereby acknowledged by these presents have granted bargained sold aliened remised released conveyed and confirmed and by these presents do grant bargain sell alien remise release convey and confirm unto the said party of the second part and to his heirs and assigns forever all that certain piece or parcel of land lying and being situated in Winslow township Jefferson county State of Pennsylvania which said tract of land was surveyed and returned upon warrant numbered 3853 as by a reference to said parents enrolled in the rolls office in patent Book H Vol 20 page 138 Bounded and described as follows, Viz Beginning at a hemlock North west corner and south east corner of Adam Yohes land thence South thirty degrees West ninety four per ches to a hazel thence South ninety degrees East fifty six perches to a post South fifty nine perches to a hemlock thence North Eighty nine degrees East two hundred and thirty one perches by land of John Pifer to a Poplar thence North one degree west seventy eight perches to a Beech thence South eighty nine degrees west fifty perches to a birch thence North one degree West sixty perches to a hemlock thence by land of Samuel Yohe South eighty nine degrees West one hundred and ninety four perches to the place of beginning containing one hundred and eighty seven acres and allowance of six percent being lot No 3 and part of lot No 2 of tract numbered 3853 as aforesaid together with all and singular the tenements hereditaments and appurtenances thereunto belonging or in anywise appertaining and the reversion and reversions remainders [sic] and remainders rents issues and profits thereof and also all the estate right title interest dower and right of Dower property possession claim and demand whatsoever as well in law as in equity of the said parties of the first part of in and to the same and every part and parcel thereof with the appurtenances To have and to hold the above granted bargained and described premises with the appurtenances unto the said party of the second part his heirs and assigns to his and their own proper use bene fit and behoof forever And the said Jacob Smith for himself his heirs executors and administrators doth covenant grant and agree to and with the said party of the second part and his heirs and assigns that the said Jacob Smith at the time of the sealing and delivery of these presents was lawfully seized in his own right of a good absolute and indefeasable [sic] estate of inheritance in fee simple of and in all and singular the above granted and described premises with the appurtenances and has good right full power and lawful authority to grant bargain sell and convey the same in manner aforesaid and that the said party of the second part his heirs and assigns shall and may at all times hereinafter peaceably and quietly have hold use occupy possess and enjoy the above granted premises and every part and parcel thereof with the appurtenances without any let [?] suit trouble molestation ___tion or distu rbance of the said parties of the first part their heirs or assigns or of any other person or persons lawfully claiming or to claim the same and that the same are now free clear discharged and unencumbered of and from all former and other grants titles charges estates Jud gments taxes assessments and encumbrances of what nature or kind soever and the said Jacob Smith his heirs the above described and hereby granted and released premises and every part and parcel thereof with the appurtenances unto the said party of the second part his heirs and assigns against the said parties of the first part their heirs and against all and every person and personsons [sic] whom soever lawfully claiming or to claim the same shall and will warrant and by these presents forever defend In Witness whereof the said parties of the first part have hereunto set their hands and seals the day and year first above written Sealed and delivered in presence of Jacob Smith ( ) Solomon Philippi Barbara Smith ( ) John Sloppy Received on the day of the date of the above written indenture of the above named John D Philippi the sum of seven hundred dollars being the full consideration therein contained Jacob Smith Jacob Davis Esq John Sloppy Commonwealth of Pennsylvania County of Jefferson SS Be it remembered that on the eighth day of August AD 1853 Before me the subscriber a Justice of the Peace county aforesaid personally appeared Jacob Smith and Barbara Smith his wife grantors in the above indenture Deed or conveyance named and in due form of law severally acknowledged the foregoing indenture Deed or or [sic] conveyance to be their act and deed and desired that the same as such might be recorded according to law she the said Barb ara Smith being of full age separate and apart from her said husband by me theron privately examined and the full contents thereof being by me first made known unto her did declare and say that she did voluntarily and of her own free will and accord sign seal and as her own act and deed deliver the foregoing indenture deed or conveyance without any coercion or compulsion of her said husband In testimony whereof I have hereunto set my hand and seal the day and year last above named Jacob Davis Esq ( )
