Written: April 30 1874 [PETITION TO SELL LAND IN KNOX TWP. 1874] In the Matter of the Estate 24 of David Swab Deceased Sale of Real Estate. At an Orphan's Court held at Clarion, in and for the County of Clarion, On the 30th day of April A.D. 1874, Was presented the petition of John Keck Administrator of the Estate of David Swab late of the said County deceased setting forth. That the said David Swab died intestate, seized in his demesne as of fee of the following Real estate to wit: All that certain piece or parcel of land situated in the Township of Knox, County of Jefferson and state of Pennsylvania bounded and described as follows viz: Beginning at a Hemlock thence North [88.5 degrees] West one hundred perches to a Hemlock, thence North [1.5 degrees] East one hundred and seventy two perches to an Ironwood, thence South [88.5 degrees] East one hundred perches to a post, thence South [1.5 degrees] West, one hundred and seventy two perches, to the place of beginning Containing One hundred and two acres and one hundred perches more of less. That the personal estate of the said decedent is insufficient to pay his debts and that it is requisite to sell a portion of the real estate of the said decedent for the payment thereof. That the petitioner has annexed a true and perfect Inventory and concionable appraisement of the personal estate of the decedent, a full and correct statement of all the real estate of the decedent and a just and true account upon oath of all the debts of the decedent which have came to the Knowledge of the petitioner. And praying the said Court to authorize a sale by him of the Real estate described in the petition. A perfect Inventory and concionable appraisement of all the personal estate of the said David Swab deceased Amount realized from sale of personal property at vendue $634.95 Due from John Rader on Land 125.00 759.95 A full and correct statement of all the Real estate of the said David Swab deceased to wit. 1st The property described in the foregoing petition 2 One hundred and sixty two acres of land more or less situate in the township of Redbank, County of Clarion Penna. On which is erected a dwelling house and barn, about 100 acres of which is under culture, same being the homestead of decedent. A just and true account of the debts of the said David Swab deceased so far as made Known to the petitioner. $2,218.95 And now to wit April 30th 1874, The petition of John Keck Administrater of David Swab late of the said County deceased was presented setting forth in the petition, That the said David Swab died intestate seized in his demesne as of fee of the following real estate to wit: All that certain piece or parcel of land situated in the township of Knox County of Jefferson Pennsylvania bounded and described as follows, Beginning at a hemlock, hence North [88.5 degrees] West One hundred perches to a hemlock thence North [1.5 degrees] East one hundred and seventy two perches to an Ironwood, thence South [88.5 degrees] East one hundred perches to a post, thence South [1.5 degrees] West one hundred and seventy two perches to the place of beginning Containing One hundred and two acres and one hundred perches and allowance. That the personal estate of the said decedent is insufficient to pay his debts as appears by the schedule thereunto annexed and that it is requisit to sell a portion of the real estate for the payment thereof. And therefore praying the Court to authorize a sale by him of the real estate described in said petition, and he administrater having first filed in the office of the Clerk, of the Court a bond in the sum of Three thousand dollars with H.K. Carrier and Conrad Keck as sureties who are approved by the Court, conditioned for the faithful application of the proceeds of sale according to his duty as required. Whereupon the said Court having read and considered the said petition, granted the prayer thereof, and awarded an order to expose the said described real estate of the said decedent as set forth in the said petition at public sale after having given due notice of the sale according to law or the Act of Assembly in such cases made and provided, or so much therof as shall be necessary to raise fifteen hundred dollars. By the Court W.P. Jenks Prest. Judge Same day Bond filed in the sum of three thousand dollars with H.K. Carrier and Conrad Keck as sureties. No attempt has been made to correct spelling, capitalization or punctuation. Demesne means: possession of ones own or domain. A perche is a unit of measurement of both length and area. The lineal perche is equal to 19.183 feet or 5.847 meters. The area is equal to one square 368.0 square feet or 155.33 square meters.] Additional Comments: David Swab's debts exceeded the funds avaible to pay them off.
