Lease for Oil, Gas & Coal exploration Written: May 17 1880 Recorded: June 18 1880 This Lease made this seventh day of May A D 1880 by and between Adam Swab of Perry Township of the County of Jefferson and State of Pennsylvania of the first part and Dinsmore Howe & Co. of Punxsutauney and Franklin of the second part Witnesseth That the said party of the first part in consideration of the stipulations rents and covenants hereinafter contained on the part of the said parties of the second part their Executers administraters and assigns to be paid kept and performed hath granted demised and let unto the said parties of the second part their executers administraters and assigns for the purposes of laying Pipe Lines runing and excavating for Petroleum Coal Rock or Carbon Oil Gas or other valuable mineral or volatile substances all that certain tract of land situated in Jefferson County and State of Pennsylvania and bounded and described as follows to wit On the North by lands of John Miller Isaac Mank et al On the East by land of Thos. Gearhart On the South by lands of Jos. Moltern and on the West by Henry Bush Containing One hundred and fifty acres more or less first drilling to be done on Fifty acres on East end of said farm lying along lines Jos. Moltorn. To have and to hold and said premises for the said purposes unto the said parties of the second part their executers administraters or assigns for during and until the full term of twenty years next ensuing the day and year above written. The said parties of the second part here by Covenant in Consideration of the said grant and demise to deliver unto the said party of the first part his heirs and assign the full equal one tenth (10) part of the Petroleum Coal Rock or Carbon Oil or other valuable mineral or volatile substances discovered escavated pumped and raised on the premises herein leased as produced excavated or pumped in the crude state. The said party of the first part is to fully use and enjoy the said premises for the purpose of tillage except such part as may be necessary for said mining purposes pipelines and right of way over and across the said premises to the place or places of mining or storage. The said parties of the second part are further to have the privilege of using sufficient Coal and Wood from the premises herein leased to run the necessary engines for the prosecution of said business. Also timber for rigs. No timber to be cut without the consent of the party of the first part. Whereas the parties of the second part desirous of prospecting for a new oil field and whereas a small amount of territory will not justify a test venture and whereas the said parties of the second part have leased a number of farms in Jefferson and Indiana Counties it is agreed that the said parties of the second part shall Commence operations within already begun from this date on a test well on some one of the farms leased by them as aforesid and prosecute the same with diligence to completion and so on until not less than four wells shall have been drilled on the territory leased by them and within sixty days after the completion of the said fourth well shall begin a well on the lands herby [the next several words are illegible] shall be null and void and the party of the first part may re-enter and take possession of the premises by giving thirty days notice in writing to the parties of the second part or their assigns. The said party of the first part covenant and grant to the said parties of the second part the right to remove any machinery or fixtures placed on said premises by the said parties of the second part. State of Pennsylvania } Jefferson County } SS Be it remembered that on the twelvth day of June A.D. 1880 before me a Notary Public in and for said County personally came Philip Whitesell who being duly sworn doth depose and say that he was present and did see Adam Swab the grantor in the above Indenture of lease sign seal and as his actual deed deliver the same for the purposes therein mentioned and that the name of Adam Swab the said grantor subscribed to the said Indenture as the party executing the same is in the proper hand writing of Adam Swab and that the name of Philip Whitesel attesting witness is in the proper hand writing of myself Philip Whitesel Notary Seal Sworn and subscribed before me this 12th day of June 1880 Thomas J.
